Hello, 

 

If anyone is willing to shed some light or help, I would really appreciate it. My fiance was denied the k1 application because of marijuana possession from 2014. Nothing went wrong the medical examination or the interview. This was the only problem and they denied him because of that. So now we were advised to proceed with the waiver process. Can anyone give me some advice as to what to expect or what I really NEED to do. 

 

Thank you in advance. This has been the hardest thing ever.

You have 30 days to appeal the decision with an I-290B ($675) or you could start from scratch and refile a K1 again. Either way the outcome isn't guaranteed and retaining a lawyer is helpful to getting a better outcome once you are rejected. Once you get counsel and decide which route to pursue, you can reach out to your local senators to try and get help on it. Time is the most important factor here. 

There is also the CR1 route, but in your situation, I don't think it would help.

1 year ban i assume? Probably easier/cheaper to just wait it out.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

WRONG!!!!  This is not a one year ban issue and cannot be appealed.  You will need to talk to a lawyer about a waiver.

No I think this is different. He didn't admit the use of marijuana but it seems like it was a conviction for POSESSION of drugs. That makes a big difference for the immigration process.

Didn't see that it was a ban. OP noted rejection. They should definitely follow up with a lawyer for the waiver.

Hi, thank you for all of your input. There is no one year ban. There was a follow up interview in which they told him he was denied and needed to fill out the waiver. My question was about the waiver process and what I need to know and should expect in this process. I just wanted to know if any one had experience with this or any recommendations. There was not an admit of usage or any issues with the medical.

They have up to one year to file the waiver, if that is denied then they have 30 days to appeal that

 

OP you should speak to a waiver atty its doable, try Lizz Cannon ...google her
