Hi,

 

I am the petitioner. Could someone please tell me which packet to put my divorce decree in. Would this go into the IV, or the AOS?

Also I noticed a check list.  Do you only receive a checklist if you failed to provide something, or is this standard with every case?  Thanks so much for all the help.

Since it's a civil document, it will go in the IV package. If you get a checklist, it means you either didn't provide something, or you did, in fact, provide it, but the NVC misplaced it. Either way, I think you will have to send in whatever they asked for in the checklist

To answer your question, you wouldn't put your divorce decree in either packet, here's why:

 

Since you are the petitioner, the NVC is not interested in your divorce decree (or any other civil document from the petitioner for that matter); they only want civil documents from the beneficiary (which would include a divorce decree if applicable).

If you are applying for an IR1, CR1, or F2A visa as the spouse of a U.S. citizen or Lawful Permanent Resident and your petitioning spouse was previously married:  You must obtain evidence of the termination of EVERY prior marriage your petitioning spouse has had. This evidence must be an original or certified copy of one of the following documents:  FINAL legal divorce decree, death certificate, or annulment papers.

• Send a photocopy of the petitioner’s marriage termination document(s) to NVC.
• Bring the original petitioner’s termination document(s) plus a photocopy to your visa interview at the U.S. Embassy or Consulate.

So, yes, your spouse must submit your divorce decree in the IV packet.
