Pictures with his daughter, mom, family and friends I already have from my previous trips. I talk to his mom everyday via what's app and IMO and when she comes to work here on her work visa I have spent a couple of weekends with her. He met my mom, cousins and aunts the same day I met him and watched him like a hawk every night we went out..lol. 

In regards to the engagement, I was actually caught by total surprise when he did it on the last day of his birthday trip while we were in the Bahamas. If I could submit a video with the packet they would see how shocked I was. But we have no secrets and I was upfront with him about still being legally married and my babe understood.  But I understand what you mean about questioning it. Do you think I should include a copy of my divorce petition along with the PFA I took out against him 5 years ago to help show proof that I wasn't intentionally trying to get married before divorce? Because I don't even know how to track my ex down because I've moved so many times to avoid him finding me and that's before I even went to Jamaica and met my babe. 

He proposed in September and I filed my divorce in March 2017. The only reason why I didn't file earlier was because I had paid up for him to come visit me and some of his family members here in the US during thanksgiving and meet my son in person since they talk via IMO but he was denied entry and I had lost out on some money. 

 

Any advice you provide I would appreciate it.

Honestly, it seems like you are good to go. No matter how hard the embassy is, if the relationship is bonafide then its bonafide. 7 visits is a lot for K1 standards, and most people here who got approved don't even have that many visits under their belt.

 

MAKE SURE you are there during the interview at the embassy as it will help your case even more. GOOD LUCK!

Your case is reasonably strong, especially with all the visits and you planning to be there for the interview.

 

ALL children must be listed on the i129f petition and subsequent ds160, regardless if they are immigrating or not. Anything else would be misrepresentation. You don't need supporting evidence for why the child will not emigrate, staying with the other parent in his/her home country is perfectly reasonable.

 

Yes, he has had a visa. Yes, he has been denied entry. No, it should not effect his K1 chances. He was probably denied entry due to suspicion of immigration intent? With K1, that's obviously no longer a problem.

 

Make sure he knows the details about your ex-husband, separation and divorce, as it might be brought up during his interview.

If it isn't difficult, it isn't worth it.

I was thinking that my multiple visits would be a great thing to help, especially with all the evidence we have. I will DEFINITELY be there with him during the interview not only to answer whatever questions they might have for me, but because his experience when he was trying to visit me on this Tourist Visa was HORRIBLE. And because he was alone during that experience, I promised him that he'll never be alone again when it comes to dealing with my government. Plus, I've never been to Kingston before (he lives in Lucea, P.O. Hanover) so for me I would like to go just to say I've been and check it off my bucket list. LOL!!!

I was thinking I would have to add his daughter so thanks for clarifying that. I want to make this process as smooth and painless as possible which I know is hard to do with this consulate. Yes, he was denied entry because they thought he was coming to marry me and stay while traveling on a Tourist Visa (which was NOT the case which is what I told the officer on the phone when he called me that night all rude and wrong, SMH). Obviously, there was no way I would be able to marry him when I'm still legally married to someone else at that time. But the officer said that while they believed that he was coming to visit they didn't believe that he was going to leave on the date intended EVEN with proof of airline purchases/tickets and receipt for his return trip home. But what's done is done.

 

My babe knows EVERYTHING that has happened in my life prior and about my ex. We have NO secrets!!! But I will make sure to grill him about the details the closer we get to the interview.

 

Question: When sending the packet, should I add a copy of my divorce petition or restraining order that I took out back in 2012 to help show proof that I've been separated since then? Or what kind of proof should I provide about this? I've moved like 4 times in the last 5 years just because of fear that he might have found where me and my son were. So any advice you might have I would definitely appreciate.

I don't really have any experience with this type of situation. Personally, I would hold those pieces of evidence for the interview. USCIS is happy as long as you have met in person and you are officially divorced before sending the petition. Many couples have started relationships prior to divorce finalization.

If it isn't difficult, it isn't worth it.

Awesome! Thanks for the feedback. I just told my babe this morning that I'm already getting nervous as I'm assembling the petition packet and of course, he's not nervous...yet. But as we said this morning and almost every day since that we're in this together and will have to take this step by step each day. I just have to learn not to second guess our relationship because we know what's real and we have TONS of proof but we just never know what CO we get and what type of mood they're in that day. Just have to pray and leave it in God's Hands.

Uscis does not accept videos or electronic devices, CDs, etc. Write it in your statement of how u met and established ur relationship. 

 

Regardless of what others state, each embassy is different and have their own cultural norms for approval. It is not the quantity of anything, it is the quality of time spend together building a relationship. They want to be able to read and image ur story supported by evidence of ur story. 

 

Ur divorce. Documents are required in ur paperwork. If u want to explain the issues. In the marriage etc. put it in ur. Story. It's not necessary to submit anything else.

I hear you loud and clear. Quality over quantity.

 

I will have the final divorce decree added into the packet and listed on the cover letter. And just be ready to answer whatever questions they asked at the interview.

IMO your expectation of him having his interview in August/September is a little unrealistic. Some people from December are still waiting for approvals of their petitions. The average processing time just for the I-129f to get approved like is 3-6 months I think, but the 3 months is highly unlikely. Some people from January are starting to get approvals, but just a heads up that you may want to anticipate a bit more time than Aug/Sept. Then after your approval it takes another 1-2 months for the interview process depending on how far out interviews are booked with his embassy. I filed last month and I would be the happiest girl ever if my dude gets his interview by Aug/Sept, but the way things are moving it seems unlikely. (I really hope I'm wrong on this point tho :))

 

As for the other comments about K1 not being the best option, I'm not really sure as I'm fairly new to all of this, but it seems to me like you guys have a crazy amount of visits so I can't imagine that you wouldn't have a strong case for the K1.

I've been paying attention to the November/December/January/February filers and with the holidays, new fee and form changes, etc., I purposely decided to file in May because with the exception of Memorial Day and July 4th, the summer is pretty open with no holidays until Labor Day; and even then, the next one isn't until October. But we've already are anticipating at least 5-6 months from filing the packet until the interview being scheduled; which could be early-mid September, although, we'll get a jump start on the docs and information he needs to have for his medical exam and interview. I saw a thread where a young lady posted the Packet 3 checklist and I saved it to my computer and sent him a hardcopy so that he knows what to expect and where to go to get these items. Of course, I hope for August simply because I've looked at other timelines on here that I have around the same timeframe I'm looking to file and with the same consulate (Kingston, Jamaica), and some have gotten approved in 4 months. But I know things are case by case.

 

We've made over a year already, so another 6 months will be nothing. Plus, I visit so frequently that we won't even recognize the time flying by. :)

I agree with this! I'm from the U.K. And met my husband August 2015 while I was working in the US. We planned for me to visit February 2016 and he proposed (after I told him numerous time we should wait) and applied for K-1 right away. We were approved in September 2016 so had only known each other 13 months by this time. I don't know much about Jamaica and the consulate there, but going purely on how many times you've visited and the depth of your plans for the future together, you should be good to go! Good luck with everything!!

 I met my husband on a dating site in May 2015

He came to Jamaica in July 2015, he spent 5 days.

He visited again in September 2015. spent 4 days.

He filed for me in January 2016, and he visited me again in March 2016

my fiance visa was approved in March 15 2016. So he filed for me 9 months after we started dating.

After that I did all the necessary paperwork. I received my visa in June 2016, and came to America in July.

You can file for him, you just need proof that you met him. Just make sure the relationship is legitimate.

It's not too soon. Plus you visited him many times. k1 is the right visa. Try it. Just think positive. Never lie to Immigration, They know. It's all in the system, so if they asked about obtaining a visiting visa, let him say yes,and explain what happened. good luck!

Thanks for responding. I appreciate you sharing your experience with me. We're gonna do the K1. I'm just gonna make sure to front-load the petition with as much evidence as I can and the rest will be in God's Hands. We know what we have is real and we're gonna do this whole process together. I believe that me attending the interview plus alllllllll the evidence I'm gonna put in (trust me I have a lot), I have enough to not have them severely question my recent divorce. But if they do, we'll be ready!!!
