From my vantage point CBP is getting more militant, entering expedite removal orders rather than just turning people around.

Having a B2 doesn't mean CBP will let her enter the country.  She will be refused entry if the believe she has more of a reason to stay in the US than to go back to her home country.  For example, one reason they might let someone get a visa and enter the US is if their only child remains behind. Of course, the more people enter the US like this and leave the child behind, and do not return to the home country, the more likely it is that other will be prevented from come to the US on a tourist visa.   My recommendation is to follow the standard process.   As a permanent resident you can sponsor a child, BUT........it will be much faster for your husband to do it as a citizen, as there are no waiting list, due to numerical restrictions,  for US Citizens to sponsor a minor child.

Also, if you didn't list her, I would think you need your own I-130 being approved before you can consider the benefit for your daughter. Applying for Adjustment of Status does not mean you have been granted the benefit. The change in status will only be approved at the interview when both you and your husband will attend and prove that it is a bona fide marriage.

I did list her on my i130 but because of funds I wasn't able to put in a petition for her with mine as well. 

 

My husband will be the one filing a petition for her not me

Hi...just wondering where you are in this process.

 

Im the USC..husband from JA. We filed an I-130 for his son back in March 2017. Still waiting to hear back.

Still waiting on word from uscis. But I know it suppose to be 6 month from the date that they receive the packet

Also heard up to 1 year...hoping to be able to expedite that

To me it's not worth the expedite. The embassy are gonna take their own time to do things. So even if I expedite the embassy is not gonna move any faster. Plus it give me time to get school enrollment done. Activities and such...and plus I don't want to pull her out of the middle of the school. I planned it so she will be here by the end of summer. If there are no major delays

Good point.

 

But that also depends on where the child is coming from and what their home life is like. Some kids need expediting due to illnesses,  financial reasons, or humanitarian reasons...Especially with these hurricanes and earthquakes going  on and severe loss

 

Anyways...lets keep in touch. I'll write in if I hear back anything.

We got our letter yesterday...Petition approved 9/28 for my step-son in Jamaica!

 

We should expect instructions from the NVC within 30days.
