Received NOA 2; What Documents are needed now?

Hello Everyone,

 

I just received the I-797 NOA 2 which states that our K-1 Fiance Visa petition has been approved.  Can someone please tell me all of the documents that are needed for the next step in the process?  I have read some information on Visajourney about which documents to obtain at this point, but then in the forums people have mentioned additional documents not mentioned in the Visajourney list; For example,a copy of the beneficiary's birth certificate (translated in English).  Also, the Approval Notice has a validity date of April, 5th to August 4th of 2017.  Does this mean that all of the necessary paperwork, medical exam, embassy interview, etc. must be completed within this time frame?  Thanks in advance for any help that you can provide.

The general documents needed are in the guide (http://www.visajourney.com/content/k1guide). Beyond that, it's embassy specific what you will need. That will be included in the Packet 3, which may or may not be mailed to the beneficiary depending on the embassy.

 

That's the initial expiration for the I-129F. As long as the case is still being worked on, the embassy should renew the petition automatically.

This list will vary some from embassy to embassy. I will list the MUSTS that all embassies will require. Since you haven't listed where your embassy will be, nobody with experience at that embassy can chime in. 

  1. You will need the translated birth certificate
  2. Police records (translated if not in English) for every country they have lived longer than 6 months
  3. Affidavit of support showing that you make more than required amount of money. Include with said affidavit a letter from your employer on company letterhead discussing are you salary or hourly, part time or full time, what is your yearly wage, how long have you worked there, etc. Paystubs (up to 6 months worth doesn't hurt), IRS transcipts (easy to get from the IRS website). Letters from an officer of the bank where you hold an account, listing your account balances and what not. If you are self-employed then it gets really diffcult and I can't help you there
  4. Proof that you two have met in the past two years: this should include pictures, flight plans with both of your names on them, any other dated travel document that has both names on it. Keep in mind this information should show both 1) that you two have met and 2) that it is in the past two years.
  5. Proof of a bonafide relationship: this will include pictures, letters, conversation records, phone call records, etc. Things like pictures and conversations showing you meeting your fiancee's family are always good, same with your fiancee meeting your family.  We also sent things like receipts for flowers, gift, emails, etc. 
  6. If you or you fiancee have been married before, our embassy required both the original marriage certificate AND the divorce certificate. Keep in mind if the only time you have met is before your divorce was final, it DOES NOT COUNT. 

Otherwise, stuff will be very dependent on the country your fiancee is living in.

(3h later) - She is told that she is approved and to expect her passport soon (how when they don't have it in their posession?) After clarification, instructed to send our passport to them. Ship out passport in a rush to beat Songkran (which failed) --> 04/11/2017 - Passport at embassy according to Thai Post Office --> 04/17/2017 - Emailed to confirm they received the passport. They issued an evasive answer about Songkran backlog (they love evasive non-committal answers)--> 04/24/2017  Evening - Case changes from Immigrant Visa to Non-Immigrant Visa and a new case created date is given --? 04/25/2017 morning  (less than 12h later) - Case flies through Ready -->Admin Processing --> Issued

This isn't necessary as that has already been affirmed in the I-129F processing, and proof of that is already included in the packet.

 

That said, it's generally a good idea to also include a copy of the NOA2 as well as a copy of your entire I-129F packet (and any RFE responses). The CO should already have this, but papers do get lost/misplaced, so having a copy on-hand at the interview can save you from a 221g pending additional documents.

You are correct, I think we just included it as part of our evidence of a bonafide. I will strike it out from my advice.

As stated earlier, the next step is country/embassy specific.  Updating your timeline and adding or even mentioning the country the foreign fiance is from will help us help you.

Thanks for your replies.....I'm American and my fiance is Thai.  The interview will eventually take place at the US Embassy in Bangkok so if you have any more information that is embassy specific, please let me know.  I'm going back to visit the US this month for about six weeks.  Following my trip, I'll take all of the required documents (bank letter, statements, etc.) back to Bangkok.  In the meantime, my fiance is working on getting the police certificate, certified translated copy of the birth certificate etc.  By the way, I live in Bangkok so we have the luxury of going through this process together.  I look forward to your responses.  Thanks again:)

My fiancee is going through the Bangkok embassy right now. They post the packet 3 requirements on their website.

Go there and select Packet 3 instructions for K Visas. It has a list of every single document that you two will need to prepare.
