I was married for 6 years with my previous husband but we got a divorce first husband got his visa through me. Whats are the odds I cam get my current boyfriend a visa to come here? Are we going to have a hard time getting the visa approved?

Your boyfriend has to apply for a tourist visa by himself. The US embassy in his home country/city will decide if his visa gets approved or not.

If you are referring to obtaining him a K-1, well, you are required to have met within the 2 years prior to your filing date of the I-129F in order to even be considered for one. Make sure you have the necessary evidence to prove the meeting(s) as well as your relationship to the USCIS in your I-129F paperwork first before you get to the embassy level for the K-1.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

You are rather ambiguous in your question, in that you don't state whether you are looking for a B1, K1 or CR1 visa.

 

B2 aka Tourist Visa - You literally have no impact on him getting a tourist visa. It is ENTIRELY on the embassy in his country and his ability to convince them that he has sufficient and strong ties to his home country. My fiancee came through a notoriously difficult embassy (Bangkok) but she prepared VERY hard in advance. She had loads of documents, letter from her HR, rental agreement, bank accounts, etc. She was approved with five very simple questions. Her subsequent renewal interview went similarly easily. 

 

K1 Visa aka Fiancee visa - I am a divorcee who would be in a similar situation to you. In fact, my fiancee and I first met long after my ex-wife and I had separated but before the legal divorce (long story). That being said, we met multiple times AFTER the divorce was finished too. We submitted to USCIS and received our NOA2, we are in the midst of a rather complex embassy portion which has nothing to do with my divorce but instead has to do with the fact her home country and current country of residence (Thailand) are two different countries. Ours is the closest you can get to an open and shut case, other than the divorce and the two countries issue. We have met multiple times, has had two B2 visas and returned properly on both, she stayed with me for 4 months, she has met ALL of my extended family ,communicates with my parents regularly, I have met her extended family and am the favorite 'relative' of her niece, we have loads of pictures, documents, I make more than enough money, etc. etc. etc. If you have a sufficiently built case, you will have ZERO issues. 

 

CR1 Visa - This should be similar to a K1 visa, meaning you should be just fine

We suspect that our case was approved at this point but they didn't have her passport. --> 04/10/2017 (10 days after interview) - Email emabssy to inquire about updates and if there was anything we could do to move things forward. (3h later) - She is told that she is approved and to expect her passport soon (how when they don't have it in their posession?) After clarification, instructed to send our passport to them. Ship out passport in a rush to beat Songkran (which failed) --> 04/11/2017 - Passport at embassy according to Thai Post Office --> 04/17/2017 - Emailed to confirm they received the passport. They issued an evasive answer about Songkran backlog (they love evasive non-committal answers)--> 04/24/2017  Evening - Case changes from Immigrant Visa to Non-Immigrant Visa and a new case created date is given --? 04/25/2017 morning  (less than 12h later) - Case flies through Ready -->Admin Processing --> Issued

04/26/2017 - Checks mail, passport is there. No mention of it being mailed out. 

05/02/2017 - Arrives in the USA, without Issue

06/17/2017 - Marriage!

My ex-husband is from Dominican Republic and my current boyfriend is also from dominican republic. My husband and I were married for 2 years before I petition for him, he came to the states and we were married for another 4 years. Everything was great at first till he cheated on me for the 3rd time so I decided to file for divorce. He got his 10 year visa but never filed for citizenship, now I am in a new relationship and would like to petition for my current boyfriend to come. I really don't know the route I should take whether to marry him or just file for the K-1 visa as a fiance

You can file either route.: As long as you can show that you have met your fiancee in the past 2 years and you weren't married when the two of you met then you should be fine. How long ago was it that you got divorced?

The divorce will be finalized the 18th of this month, we actually been seperated since last august.

I don't think it should matter if you met while technically married (at least I hope not!!). In Canada you have to wait a year before you can even file for divorce.  I separated from my ex-husband in early July 2015 and met my fiance in august 2016.  I filed for divorce that same month and even though we did a joint divorce and had nothing to fight over, it only got finalised in late January 2017, and we filed our I-129f A few weeks later.  I will still have to wait another month or so to see if they approve it though.

Any meeting you had before the 18th of this month will likely be considered not valid as you are still legally married. At least that is what I have been told by a few posters on here. Truthfully, I don't know if there are any rules which are set in stone.

By last August, do you mean August 2016 or 2015? If 2016, I would expect that you might be treated with a LOT of suspicion due to the rapid turn around time (this would apply for both marriage and fiance visas). If 2015, then expect that you might have to document that you two were separated from that point.

Who are these posters? That is the most absurd statement Ive ever read on here. 

 

The 129f (K petition) requires you to have met with in 2 yrs of filing it. It has no such provisions for what your relationship status has to be during the meeting. But lets use common sense here- it can be harder to get approved when you have overlapping relationships. Harder. Not impossible. Sometimes its an issue sometimes its not.
