Hi Guys,

I am an international student who just finished his program not too long ago. I have SSN and I applied for OPT and was approved. So I am currently working with my OPT which does not expire till 01/18. My wife whom is U.S citizen decided its time to change my status. I am trying to figure out what documents I need and the forms I need to fill out to apply for a green card. A burning question though is, Do I need to fill out Form I-765 (Application for Employment Authorization)?

Yes you do, but mark hat it is a renewal in the C9 category. If you don't fill this out, and your green card arrives after 01/18, you would have to stop working. By getting a renewal EAD in the proper category for marriage, you can work indefinitely in any field.

04-05-2017 RFIE notification

04-07-2017 Biometrics letter arrived

04-10-2017 RFIE letter received for birth certificate (that we already sent)

04-11-2017 InfoPass and mailed RFIE response

04-19-2017 RFIE response received by USCIS

04-21-2017 Biometrics appointment

06-08-2017 EAD/AP approved (day 80)

10-03-2017 Sent online case status inquiry for I-485

11-06-2017 InfoPass appointment about case status 

12-05-2017 Requested case update from Congressperson's office

01-22-2018 Interview!! Approved on the spot

Yep, my husband was in a similar position and we submitted paperwork for the EAD, just think about it like, you're now receiving an updated EAD under your new status, which is adjusting as alien relative. It's safer this way, the process could go longer than 01.18, then you'd be stuck having to renew it anyways. It's also free to file it with the I-485 so there's really no point NOT to.

12/14/2016 Mailed I-130, I-485 & I-765

01/04/2017 Received NOA via text and email for I-130, I-485 and I-765

01/05/2017 Both checks are cashed

01/09/2017 NOA received in mail for I-130, I-485 and I-765

01/23/2017 Biometrics Appointment notification received (Appt set for 02/02/17)

02/17/2017 I-485 Status updated to "Case is ready to be scheduled for an interview"

03/23/2017 Case Status updated to "EAD Card is being produced."

08/30/2017 Case status updated to "Interview Scheduled"

09/28/2017 Interview! Status updated to "New Card is being produced" shortly after interview!

10/06/2017 Green Card arrived!
