Hi all,

 

My wife's AOS from K-1 has been pending since January 2016, with no news except for an RFE in February 2016 and our response the same month. The USCIS website says they resumed work on the case then. Her EAD/AP card has come and expired in the meantime. Also, our local office is and has always been Salt Lake City, UT.

 

We're confused about two things:

1. Her case is in the New York City office. That kind of thing seems to be normal for visa waivers. However, we're not certain that she's a waiver because

2. To date, we have not received a Notice of Potential Interview Waiver.

 

Do those notices still get sent out? I haven't seen any recent posts about them...

Even without the notice, can we be sure that she's a waiver since her case has been routed to NYC? Or could that be some kind of mistake?

Haven't seen any letters of interview waivers going around since, I guess, late 2015. It could be a mistake but most likely they want to skip the interview and the case was sent to be processed at another field office. Try contacting your local congress person to see if they can find out why is it there or more info regarding your case.

 

if the ead/ ap is expired, you can send a new packet for renewal, be sure to send the noa1 for the i485 and there will be no cost for the renewal.

 

and just to clarify, it's not visa waiver, since shes already here and going through aos, she doesn't need a visa

Thanks! Does it make a difference whether I contact my senator or representative? Maybe I'll try both.
We did apply for the renewal EAD/AP, just not soon enough. It's over 75 days now though so we'll give USCIS a call. :)

Yeah, "visa waivers" should read "interview waivers." Oops.
