Apparently, we submitted an outdated 864 document for and we just received a RFE. This sucks. He just went for his biomentrics on Friday adn then we received the RFE on Saturday.

Few questions (if they have been addressed in other posts, I apologize in advance):

-We already submitted all of the accompanying documents (w-2's, employment letter, et cetera) when we sent in th eAOS package. DO we need to resubmit all of those documents with the new version of the 864?

-For others who filled out this form, did you leaves boxes blank? They shoul dhave an option that says "If no, proceed to #_"---but, they don't. So we left some of the boxes empty.

-Question 21: We checked 1 for me and 1 for my husband, Carlos, totalling 2 people. In the directions, it says not to count twice. But, should we choose one box over another for Carlos (a or c?)?

-Question 24: Carlos does not have his EAD, so he has no income. Therefore, we did not list Carlos. Can we leave those lines and boxes blank?

-Question 25: When we originally sent in the AOS document, we sent in tall the tax form info. DO we need to attache this info again?

-On the RFE, it says something to the effect that the person being petitioned cannot work for an additional 90 after they are in receipt of this RFE. This doesn't make sense. Are they tacking on even more time where Carlos cannot work?

11/03/06: Carlos arrives in the States for the first time

12/05/06: MARRIED MARRIED MARRIED!!!!!

01/11/07: Applied for SSN

01/17/07: Received SS card in snailmail

03/13/07: Submitted AOS and EAD

03/22/07: Received NOA1 for both AOS and EAD in mail

03/24.07: Received Biometrics Appt. letter

04/06/07: Biometrics Appt.

04/07/07: AOS RFE (used an outdated form. argh!)

04/10/07: Mailed RFE

04/18/07: USCIS notes that processing has resumed

06/18/07: EAD received

06/19/07: Greencard!! No interview!

Question 21 since you are SPONSORING your spouse they are counted as (a ) NOT (c ) the form says "Persons NOT sponsored in this affidavit" for (b -- g).

Question 24 Line (a ) is the sponsoring persons income copied from line 23 on previous page, for (b ) you can leave blank.

Question 25 I would attach copies of the tax returns to the new I-864 (1040,w2,1099)

Not tacking on additional time, and since he has no EAD he cannot work anyway.

Is now a US Citizen immigration completed Jan 12, 2012.
