Understood now. For the record, I think you've got good understanding and I respect your posts.

I should have been more direct and to the point yesterday about I-134 v I-864. I agree completely with you and pax about referring people to the web site of the specific consulate they are concerned with. I agree with your point that different consulates have different policies and procedures to suit local needs and preferences. One area that consular web sites are not always clear about, however, is the affidavit of support to be used for the K visas, but I'm going off on the tangent again .......

The specific phrase of interest, which I see so often, is "some consulates require I-864". I ask the same question everytime I see this, not just of you. The few first-hand experiences that I have received in response to that question were from people who reported that they were told they could use either, and they had opted to use I-134. I have yet to see a post that said "I was required to provide I-864 for my K visa".

When you come across such a post please let me know, because I'm sure I miss many posts, and I would like very much to know if the phrase is accurate and if it is which consulate is the culprit.

The contradiction comes into play when you expect me to read (you are perhaps giving me credit that I will be able to 'drink') but you don't ask the same of a new member (hence assuming that he is unable to 'drink'). I'm not certain which one of us is getting credit for having brains, if indeed you are subscribing that to anybody.

I think what confuses people is that some consulates do require 3 years of tax returns with the I-134.

And therein lies the rub. If there are such consulates doing so, they should not be...at least according to the instructions for the I-134. It specifically states tax returns are only required of the self employed.

Yes and it would get confusing. The thing is though that the I-134 and supporting documents are only one aspect of a Conof determining if an applicant will or wont become a public charge. My understanding of some consulates requesting 3 years is to assist in determining that.....not that they are required for the I-134 itself.

Most embassy websites seem to only also state that an I-134 MAY be required and yet most all seem to definately require it.

True, but if I can assume that other people were confused by the same things I was, I would argue that one source of the confusion wbout which affidavit to use comes with how many tax returns your consulate requires. When I was told that Morocco must see three years of tax returns, I made the leap to thinking that meant they must want the I-864 as the affidavit of support.

Perhaps because I-134 is in fact optional at the discretion of the consular officer?

I'm sure that even the toughest of consulates would forgo the I-134 for a 'good' sponsor (Gates or Buffet come quickly to mind), and would forgo a sponsor for a 'good' visa applicant.

Really? You don't see how someone might make that assumption?

Ok, well after doing some preliminary research I knew that eventually I would need to use the I-864, which at the time I looked into it required 3 years of tax returns. From reading posts on VJ I knew that most people at interview time turned in the I-134 and 1 year of tax returns. So.... when I found out that Morocco wanted 3 years of tax returns, I assumed (yes, incorrectly) that they then wanted the I-864.
