Hello everyone. USCIS received my I-129F application on March 29th, and after nearly two weeks of me checking my bank account 3 times a day to see if the check had been cashed, the application was returned to me this weekend. It was rejected because we used the outdated version of I-129F - we had originally planned on filing months ago, so I downloaded and filled out the paperwork before December 23rd, but life got in the way and we had to delay our application until March. I sent the correct fee, but my application was rejected because of the older date on a seemingly otherwise identical form. Ok, that's enough complaining. Here are my questions, if you would be so kind to answer them if you have had something similar happen to you:

 

Every single page we submitted was returned to us with a stamp from USCIS on the bottom with a lot of numbers, including the date they processed it. Is it better to re-submit all of the non-expired documents and forms that have this stamp on it, or should I send fresh copies without the stamp? 

The personal check I sent also has this same stamp on the back and another stamp with "US Department of Homeland Security Citizenship and Immigration Services" on the front. Will they accept the same check, or should I write a new one?

 

Halfway through writing this post, I realized that I had made almost an entire copy of the packet to keep for myself, so it's not terribly difficult to send in fresh paperwork without the USCIS stamps, so really what I'm asking is - what is better? Will it delay my application again if I use either the stamped copies or the new copies, or a mix of both?

 

If you've been through this scenario, I would really appreciate your input. Thanks!

Just fill out and sign a new form.  Everything else from the old packet you can resend with the new form - even the check.  They haven't cashed the check, so it's still good.

 

Best of luck.  I got caught out with this when I was filing for Australian residency, so I know what it feels like.
