Some not so good news for those with ...

This in general also, maybe when your interview comes up and (hopefully not) you are denied then you will see the CO is putting themselves in the position of assuming it is not a relationship. They take 10 minutes without even looking at the papers to tell you this. Now if you can tell me how i can give up my job, my retirement, and have someone to take care of my elderly mom, then i will gladly move there and survive there as you say. Like i say hopefully you wont be put in this postion but its not as easy and you might think.

I don't think you get my point. Everybody's situation is different so I would not fault anybody for deciding to break up with their SO. Therefore, it is neither my decision, nor the CO's decision to make. Your decision is squarely in your hands to make.

And apparently you dont get my point, sure the interviewer/embassy can not (stop) your relationship but life in general with all its complications can surely put a hault to future plans and by denying they are stopping future plans. Many of us can not just up and move so the decisions sometimes are not squarely in our hands as you say. How many on here have you read that are already married but apart for years sometimes, you dont think if it were not for kids, jobs, etc they would go else where. Maybe in your situation both of you are young, no other family attachments and can move. Think what would YOU do if deny and the other person CAN'T go to the other, then what?

Sorry guys, I should have been more clearer.. Bala and I split in late december. I just posted this update because I knew that others have recently had petitions sent back. Just wanted them to be prepared for what is to come. My petition has been back at USCIS for almost 6 months now without a word from them. I got my info relayed to me secondhand... from the governors office.

when the consulate returns our petitioner’s approved K-1 petition to USCIS, it will put a 212(a)(6)©(1) marker, called a “P6C1” marker, or a “quasi-refusal” in the beneficiary’s record. If DHS decides at a later date to revoke that petition, a hard 212(a)6©(i) finding can kick in.

Bala and I knew each other four years , two of which was in a romantic relationship. I am 15 years older than he is and thus begins the problem. We filed the petition in 06/05 had interview in 10/05 the first words out of the interviewers mouth was "if you think you are getting a free ride to america you can forget it" .. Bala was told i was not pretty enough, so how could he possibly love me and lots of other horrible things. After that interview we were placed on AP for nearly 8 months. They then called Bala back for another interview and it was even worse than the first. They threatened to take pics of he and I to his family and friends and "make it ugly for him" if he didnt admit fraud. They said they had proof I was living with a man in america (they had called my house at 4a m and my 18 year old son answered and told them I was alseep). They tried evey tatic in the book to make bala say he was a fraud and he refused. So they couldnt get him to admit it. They couldnt find any proof to their allegations so the did the next best thing. They sent the petition back. The rest you know.

now some will say it was up to us to prove our relationship ,, we had tons of proof.. They refused to look at it. Everytime bala tried to tell them something he was met with the same words "sir we do not believe you".

I still talk with bala occasionally and each time he begs me to come there and live with him.. He doesnt care about coming to America all he cares about is being with me. But i have Children, i have grandchildren, I have bills to pay, so its not so easy.

It was a hard decision to let bala go. I love him with all my heart and soul. But I also know the fight we had before us.. I fought it for nearly two years and I thought it best to just let bala get on with his life there.

04/08/06 Back home (sigh) back to waiting again.

06/15/06 7 months on AP (will this ever end?)

07/06/06 called for second interview (it was a nightmare)

07/14/06 learned our petition was sent back

07/15/06 ready to carry on the fight!!!!

10/17/06 petition is back at USCIS

i am so sorry the consulate did this to you.

i am sure you know all of this was ilegal. there is so much i would like to say but i wont.

i too was denied a visa for my husband. he is moroccan and is happens to many times in that consulate. i fought it and proved the consulate was lying. it took 18 months but my husband is now with me. FYI my husband is younger than me too. age is not an issue for us but it seems to be an issue for our government.

i wish you much happiness.
