Timeline

Just wanted to give those of you who have had their petiton returned to CSC with the intent to deny issue. My petiton was returned in Oct of 2006 and over the weekend I received a letter from my governor (mind you I had inquired with them back in dec!!! Gives new meaning to slow reply), saying that they had been contacted by CSC and was informed they DO NOT send out noid letters and that all the petitions are EXPIRED by the time they are sent back, and I could reapply (start all over) if I wanted too. My original petition was sent in June of 2005 almost two years ago.

So all this time and effort for nothing.

06/15/06 7 months on AP (will this ever end?)

07/06/06 called for second interview (it was a nightmare)

07/14/06 learned our petition was sent back

07/15/06 ready to carry on the fight!!!!

10/17/06 petition is back at USCIS

Yeah you should definately inquire about whether you can have this case expedited or not. It seems that they do not issue these very regularly, but since it was a major error on their part, they may do this :/ Sorry this happened to you, I hope you've gotten to see your fiance a few times in the last 2 years and get to see him really soon :(

Jan 17, 2007- I-129F has arrived at the NSC

Jan 24, 2007- NOA1 date

Jan 27, 2007- Check cashed by CSC

Jan 29, 2007- Paper NOA1 recieved (at permenant US address)

May 1, 2007- NOA2

May 16, 2007- At the NVC

May 18, 2007- Left NVC

May 30, 2007- Packet 3 arrives

May 31, 2007- Faxed Packet 3 stuff back

July 9, 2007- Interview at Vancouver

July 10, 2007- Visa recieved!

July 18, 2007- US entry

August 25, 2007- Wedding <3

Timeline

There was no "error" and nothing will be expedited. CSC does not send out

noid letters and therefore this twisted logic on their part is not considered

an error.

Please go to the mena forum and get in touch with member kiya. She will point you in the right direction.

Sometimes senators and congressmen can act quickly to prevent a petiton from

being retuned. It is up to the conoff to extend the 'expiration date' of the petition.

Yours has been returned and a lot of time has been wasted.

I am sorry I can not help with specific next steps and hope kiya will help.

Sorry guys, I should have been more clearer.. Bala and I split in late december. I just posted this update because I knew that others have recently had petitions sent back. Just wanted them to be prepared for what is to come. My petition has been back at USCIS for almost 6 months now without a word from them. I got my info relayed to me secondhand... from the governors office.

Yes Vicki you are right, after it is returned back with intent to deny, looks like it is pretty hopeless. :crying: And since you were indeed approved at the US level and only denied in India, well even if you (or those in your position) started the process all over again, how likely is it that the Consulate will suddenly be happy to approve the same people?

All that time and all that money and all the heartache… it is so sad. :( Sometimes things just aren’t meant to be, but what can we do? At least hopefully we can get some strength out of the whole experience.

My interview is in only 3 days so I'm bracing myself for whatever the outcome… we are going through Chennai too, like you guys did. :unsure:

I do not see how a CO could presume to be a determinant of what is meant to be. ppl seem to forget that they are the ones who give consulates the importance that they seem to believe that they have. Unless there is a war or some sort of major disaster in your fiance'/fiancee's country, I can't see why there would be a problem living there... You'll survive. And I'm sure if applications received went down to zero, and ppl started moving to their SO's country, they'd be begging them to return. You guys have got to be joking, the USGOV has no say when it comes to anybody's relationship!!!

Nb: this is not specifically meant for you, ELW. I'm just making a general statement.

I would have to agree with that... That's why I tried to be general. If the relationship was not bonafide in the first place, the CO wouldn't be the determining factor of whether or not it was meant to be.
