Timeline

I saw someone mention that they were going to include evidence of a valid marriage in their AOS packet, is it necessary? How many people have done this, and if not, did it impact the approval?

I sort of thought that type of stuff would be addressed in an interview.

That was me that mentioned it. I know they don't ask for it, but will it hurt if a couple of photocopies and pictures are included? I'd rather try to eliminate the need for an interview all together than have to attend one and present it there. Just my opinion!

I know people that never did add evidence to their package and still got transferred to the CSC, so that is really just a random thing. I didn't send evidence, but doesn't mean that that is the reason I am having an interview.

K1 Journey:

April 13/06 NOA1 from NSC

June 1/06 - Moved to CSC

August 12/06 APPROVED - NOA2!!

August 28/06 Left NVC. . . Vancouver Bound!

September 27/06 Interview APPROVED, with visa in hand

October 29/06 Moving Date

December 30/06 Married!!

AOS Journey:

January 16/07 Sent out AOS, EAD, and AP docs

January 23/07 NOA1's for AOS, EAD and AP

February 13/07 Biometrics in Portland, OR

April 7/07 EAD and AP Received

April 24/07 Interview Scheduled . . . and APPROVED, stamp and all!

May 7/07 Greencard is in my hands!

ROC Journey:

February 17/09 Sent I-751 to CSC

February 18/09 NOA1

March 14/09 Biometrics appt.

We sent only what was asked for in the directions. We brought our "other" evidence to the interview--which was more like a friendly chat.

Don't worry about needing to go for an interivew--it was really the least stressful event of our whole process.

It's unnecessary - if they determine you don't need an interview, it's not going to be based on a few pictures and photo copies. If anything, it probably generates more unnecessary paperwork.

It's unnecessary - if they determine you don't need an interview, it's not going to be based on a few pictures and photo copies. If anything, it probably generates more unnecessary paperwork.

I Agree .. it's NOT necessary @ all .. we sent exactly what was asked for in the directions no frills and no extra evidence and we were tranfered to CSC and approved without an interview.

It is not required to send any evidence, but the latest I-130 form asks for it:

"NOTE: In addition to the required documentation listed in 1)through 4) above, you should submit one or more of the following types of documentation that may evidence that bonafides of your marriage:

1) Documentation showing joint ownership or property; or

2) A lease showing joint tenancy of a common residence; or

3) Documentation showing co-mingling of financialresources; or

4) Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or herknowledge of your marriage); or

6) Any other relevant documentation to establish that thereis an ongoing marital union."

We sent a copy of our lease, one letter from a common friend stating that he's known us for about 3 years and he has no doubts that we have a ongoing relationship, I also mailed 3 photos.. one from 2 1/2 years ago of both of us with my family and her family, one from us at a restaurant with over 10 friends and one of our civil ceremony at the court house with my parents and sister.

Yes, it is necessary to include evidence of a valid marriage with an AOS application. A photocopy of the marriage license - and translation if appropriate - satisfies that need.

Are you perhaps thinking about evidence of a bona fide marriage - a valid marriage, but one not entered into for the purpose of evading US immigration law?

A photocopy of my marriage certificate is enough to prove that i have a legitimate marriage. If you'll see my timeline, my I-485 was processed accordingly. I had completed biometrics within a month, and my case was transferred to CSC. i dont know wht's next.....maybe an interview or a welcome notice.

I just now saw that they are adjusting from a K-1 but my post will help others who are not adjusting from an immigrant visa.

No one adjusts from an immigrant visa - there's nothing to adjust when one has an immigrant visa.

I just now saw that they are adjusting from a K-1 but my post will help others who are not adjusting from an immigrant visa.

I meant to say NON-IMMIGRANT visa, like their K-1.

anyway, we sent evidence because the I-130 asks for it, if they are not filing an I-130 then don't send it. It is REALLY NOT that difficult to understand what I was saying...
