Kuwait police clearance for K1

So there is a lot of old very conflicting information on the US embassy in Manila requiring police clearance from Kuwait during the interview process. My fiancé worked in Kuwait for 2 years so assuming she was going to need police clearance from there she flew to Manila in Feb and went to the Kuwait embassy to fill out  the paperwork for her police clearance. At that time they told her it would take 2 months to receive her police clearance. Its now been 2 months and they are saying its going to take 6 months. I have also read some people waiting 8+ months. This is a real issue for us because our petition has been approved and I expect her to have an interview date by the end of April. Also the NOA2 states that it is only valid until the end of July. IF it takes 6+ months the police clearance to show up our petition approval will expire because she will not be able to schedule her interview.

I have also read that police clearance from Kuwait is exempt but there seems to be very confliction information regarding that.

If any one has RECENTLY gone thru the K1 interview process with a Filipino that worked in Kuwait I would appreciate knowing if the Kuwait police clearance was required during the interview and if so how long it took to get your police clearance from Kuwait.

As long as there is action on your case such as scheduling or an interview and then rescheduling for later date, the expiration does not matter really,t he embassy will auto renew or revalidate it. They understand things happen and sometimes people need extra time. 

 

As to the police report, definately need it and have heard that it can take quite a while from certain countries. Hopefully someone here can give you better guidance on that matter.

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Did you fiancé work in Kuwait? I read posts where people have called the US Embassy and they have been told that Kuwait police clearance is not required because Department of state does say that these are not available to former residents of Kuwait only those that currently reside there.

My fiance had to get her police clearance from Qatar, she was lucky enough that her former employer was able to get her police clearance for her. But if the US Embassy says that it's ok for her not to get it from Kuwait then you shouldn't have a problem with it at all.

Honestly I'm not sure if its required or not because there is so much conflicting info out there on Kuwait police clearances. I read things that say no its not required from Kuwait and other things that say yes it is. I  hope someone here had a fiancé that worked in Kuwait and has gone thru the interview process in the past year so I know the true story. Best case she actually gets her police clearance in the next couple weeks but that's not looking promising. I don't want her to set up an interview until I'm 100% sure she does not need it or she has her police clearance in hand.

I feel your pain. I just did the same thing that you're going through. I've called the Department of State and they said that (consistent with the link that you provided) Kuwait does not issue police clearance certificates for former residents (only current). So, like you I wasted money sending my fiance to Manila to make the request at the Kuwait Embassy when in reality we didn't need to do that.

 

The State Department indicated that the Consular should be familiar with this and it should not be a problem.

Thanks, glad to know I am not the only one. I actually called the the US Embassy in Manila for peace of mind. The woman i spoke to there confirmed that if she does not currently live in Kuwait than its not possible to get police clearance. She said to just tell the interviewer that if they ask for it. I am also going to have my fiance take a copy of the US department of state web site where it states you cannot get police clearance from Kuwait.

I'm going through the same thing, has anyone gone through the interview and been approved without police clearance from kuwait? 

I had my fiance call US embassy in manila, they said she would need it. However like mentioned above it's not available.. I've called different government places and visa processing center,  I get a different answer from every place I call...

Yep my fiance went through it on Monday they did not ask for it. I just had her print the US State Dept website page which states that the police clearance is not available for people currently not residing in Kuwait in case they asked for.it and became an issue. I also called the US Embassy before her interview and she checked the US state department website and confirm that she would not be required to provide a police report but if they asked just tell the interviewer that its not available to people not residing in Kuwait. The funny thing is if you go to the Kuwait embassy they will tell  you can get one and it will take 2 months. After you pay and call after 2 months they will say call next month but it could take 6 months. Then you call again and they will tell you less than 15% of people actually get it. Its just a way for them to take your money, dont waste your time and money, you dont need it

Thank you Shawnw,, I thought that would be the case. But with all the conflicting information out thier and how our gov can be sometimes.. It's good to know someone went through the process and was approved and did not need it....

Correct it is not possible to obtain a police clearance unless you are currently residing in Kuwait.  This is from the US State Dept web site regarding police clearance from Kuwait.  Its a bit confusing the way its written but the key words here are "available only to those residing in Kuwait." If you are now in Manila you do not need it.

 

Comments:  U.S. Citizens and other individuals: Available only to those residing in Kuwait; age 18 and above must get the police clearance certificate if they resided in the country for 6 months or more.

 

Here was my wife's experience during the interview.

 

Hello, I was working in Kiwait before and I'm finished contract with no criminal case in that country, but I still did the legal process of applying a police clearance in Kuwait embassy in Taguig. I paid 3,000 ph and they issued me a receipt, I am waiting for two months but Kuwait embassy didn't respond, so during my interview at US embassy manila, they ask me for a police clearance in Kuwait and they ask me if I had any issue or problem upon staying there,,,,i told them that I'm finished contract and show them my Receipt from Kuwait embassy in Taguig proving that I really applied, and after 3 mins checking the Kuwait Embassy in their computer the consul said that I'm good,,,so I pass the document screening.

 

That being said I do not think its necessary to apply for police clearance. It has been a year now since she applied for police clearance from Kuwait and we have never received anything.  I would not waste the 3000 ph just to get a receipt that you probably will not need.

So is it okay i will not apply for a police clearance in kuwait embassy taguig? Im not in manila i live in mindanao so for me to do that i need to fly by plane going to manila just to apply that...
