Timeline

Ok, so I'm going to visit my FI for a few weeks this month. We don't have our consulate appn't yet .. and I've already quite my job here (after stringing them along for tooo long really .. they were really nice about it tho). anyways .. i'm going to be driving out there and crossing at a land POE and showing my birth cert. and drivers license (essentially what I've showed in the past 30 years when i've crossed). does it come up on the CBP computer that I am K1 visa applicant?? I've been over several times since we've applied .. and it never has (so maybe it doesn't). it's likely that if i used my passport to cross .. it would flash as me being a visa applicant. anyone have any experiences with this???

You will HAVE to show them your passport when you cross this time because it's mandatory since January, 2007. If they do ask you about it, you will have to tell them the truth. Be honest and not lie. Try to bring as much proof with you as possible such as lease agreements, phone bills, etc etc. You have quit your job so that looks bad on you but hopefully that wouldn't come up when they ask you questions.

Not true- Passports are only required for air travel. You can cross at Land POE's using DL & BC until January 2008.

I don't think it comes up in the system with that documentation and I'll tell you why:

I was denied at POE for lack of ties when travelling with my Fiance. I too had quit my job and was naive and didn't bring anything to show ties. They didn't believe I would come back so they sent me back to Canada. They made notations in my passport and told me that if I tried to cross again that I would be banned for 10 years.

I thought that I had a right to visit my Fiance, and that I shouldn't be denied because I lacked ties. So, the next few times I crossed with my parents and showed my B.C. and DL. I brought as much evidence as I could that I was coming back. Also, my parents brought legitimacy to the crossing because they both have jobs, etc. We got through fine. Also, we didn;t mention that I had a pending application. I was just their daughter travelling with them for the weekend.

thanks for the advice:)

i have two things going for me though ....

a) i don't have to show my passport ... that only pertains to POE that involve air travel (ie: landing AT an airport in USA from a different country)... land crossing passport requirements don't come into effect until january 2008.

B) i still officially work here in Canada .. but am on my vacation leave (until the very end of april) .. so by saying I work .. I am not actually lying.

if it does come up, i have no intentions of lying ... because i know that i am not doing anything wrong. however, if i can make my crossing over as smooth as possible, that would be ideal of course. this is why i was curious to know if anyone had the K1 visa brought up to them after showing their BC and DL.

I am going to bring recent bank account transfer info (all Canadian) as well as other recent important documents with my canuck address on them ...

I wouldn't come up with your BC and your driver's license but I do hope you're bringing all your K1 paperwork with you because if you get pulled into secondary, you can show you're doing things the legal K1 way (instead of skipping across the border and staying) and that you are sooooo close to completion since your case is at the consulate.

I remember last May when I drove across the border. I gave them my BC and Drivers lic. and the border guy took it and typed something into the computer after asking me several questions and then let me pass. I don't know what he was typing, but I assume that it would pull up info on your application process. Not sure tho!

I cross at Peace Bridge every week to two weeks and have been completely honest about where I'm going and why. I have been pulled over once and they asked me a bunch of questions and they told me what I would require to carry with me every time to show proof of ties (letter from employer, lease agreement, utility bills, and my K1 paperwork).

Since then I just give them my passport and the questions are down to a very minimum and I've not since had a problem (even though I cart my paperwork with me everytime).
