Can my USC spouse apply for state insurance?

Hi,

 

I just got approved for my I-485. and we just found out that my wife got pregnant, im still looking for jobs. so i am wondering if it would be ok for

her to apply for state insurance or that would be violating the I-865 terms. ?

Yes she can apply, if she makes more than the income guidelines though she would not be approved

she does make more than the guidelines. but she has lots of loans.

I don't know if they take that into account or not but good luck and congrats on the baby

thank you. well maybe she should try and if its not approved then there is nothing we could do about it. 

i just didnt want to violate any terms of the i-865.

What is "state insurance"? Health insurance provided on your state's exchange?

 

She can definitely apply for it. Even you could, as long as you pay - you just can't apply for subsidies as a non-citizen.

I honestly have no idea too lol. she wanted to get the state health insurance just in case our private insurance doesn't cover certain things during pregnancy. I will not be applying for it as i do not qualify for it  anyway.

You mean I-864, btw, not I-865, I think.

 

As long as her income or hers + that of your sponsor is adequate and amply supported with tax transcripts, a letter of employment or past pay stubs, it's fine for her to use whatever government benefits/subsidies she legally qualifies for.
