My husband's green card says that he is from the US. This is obviously incorrect. The USCIS admits that it's their fault and told me that I MAY want to file form I-90 without the fee to get a corrected green card.

Does anyone have experience as to how long this takes?  I've also heard that I might want to make an info pass appointment to get an I 551. Do I need to make it before I file the I 90 or after?  Do I even need to correct the green card or will it matter? We are planning to travel back to the Philippines in a few months and don't want to have any problems. Any help is greatly appreciated. Thank you!

When you receive your Green Card it says that any errors need to be corrected. You should probably do the InfoPass appointment first to get a stamp in the passport, (that will act as GC while you wait), since the card itself needs to be sent back. It can take from a couple of weeks to a few months, from what I've seen.

Maybe make a photocopy of the GC before sending it off - The stamp in the passport serves as a GC as said, but for your own sense of calm, since it'll be easy to explain to anyone what happened by just showing a copy - He can still travel as a LPR :)

I've had an error on my GC as well I think I posted that on one of my topics here. What I did was I made an Acct. USCIS ELIS I filed it in there I-90 Application to Replace Permanent Resident Card. Since its their fault there is no fee for that. Here's my timeline that you can use as reference;

  • I filed mine 11/06/16 with all the proofs of error.
  • I got receipt notice by 12/22/16
  • 01/02/17 they informed me that they will just reuse my Biometric info on their system

Next thing I did was print the proof that the Status is still on process of replacement. Keeping it with me as I only travel within US Lol (you'll never know) I did this because I still want to have my actual GC with me just in case I fly back home or wherever outside US, instead of sending it back to them through mail without me having the actual card though I have my combo EAD card I'd rather have them both. Anyways I am still waiting for my new GC to arrive YES UP UNTIL NOW. (6 months today) :D

Goodluck!!

Thanks for the info!  What did you send for proofs of error?

I'm thinking to send his birth certificate and copy of the biographical page of his passport as proof that he was born in the Philippines.  I don't know what else to send.  I'm hoping that will be enough.
