While the situation is frustrating for you, .

No point copying the entire quote, but that is suggesting fraud.  It's a ToS violation to suggest an illegal act.

I can easily imagine all kinds of reasons why you have done what you have done, and hope you don't take any of the negative comments to heart. (And it only occurred to me after writing that that one possibility is sperm donation; I didn't even think of that as one of my initial scenarios!)

I suppose that if there is a very small chance that you are the biological father then a paternity test would still be the best first step.

It would seem that right now it is most important for you to be recognized as the father by the Philippines, and US concerns are secondary. I don't know enough about the Philippines to be able to advise you on what options are open to you. But figuring out a *long-term* plan to solidify your son's status in the eyes of the US government would probably be good if possible, even if that involves doing things you might not otherwise feel necessary to do (eg marriage, adoption, etc.)

There was a VJ user who had to move oversea because her husband's family falsely claimed he was a US citizen when he was a minor, it is NOT a situation you want to be in.

Just found her blog: http://carlosandamy.blogspot.com/p/why.html

I appreciate all the input,  some way off base as to knowledge and some very informative. Just so everyone knows,  putting my name as his Father was not something out of the ordinary St birth 6 years ago. Imagine yourself in your home country if your spouse had a very normal "poking baby,  not white white or brown. You naturally would be in the same boat if after time went by its appearance was certainly not like you. How would feel if nearly listing it as your child to get medical insurance meant removing your relationship as the parent to Father Unknown. We've already been down this road eith Australia for Citizenship and VISAS and this was no issue. So,  some of you back off or don't reply unless your intent is beneficial. I'm well aware of the future ramifications as it applies strictly to USA.  We only want a tourist visa.  Full Stop.

It's against TOS to tell someone not to post.  We are free to give you the advice, you're free to ignore it.  Best of luck however you choose to go.

I will post that the child is free to apply\reapply for a tourist visa. Best of luck.

Oh and btw, the US and certain countries do share information.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
