You can file for AP and EAD in the same packet as AOS.

I did K-2 he came at the same time as me. And he started school without any problems here all he had to do was the school medical. 

A K-2 can't get a SSN before they get the EAD (that's not the case with K-1) but they can still attend school and they can still get on the medical insurance.

 

If you marry in NZ and do a CR-1 visa then your kids will do a CR-2 visa.

 

Also just so you know most embassies will want a notarized letter from the bio-dad that the kids are allowed to immigrate and stay in the US and some embassies are fine with just proof of sole custody. 

thanks... my kids are in my care so don't want to leave them behind...so under a k1 visa they can come and go to school and get medical insurance?

Yes no problems. You can also do that if you decide to go with the CR-2 visa. 

 

Just remember that they will only be listed on the K-1 application BUT the will need their own medical and visa and AOS when you get to all of that and there is a separate fee for each of them just so you won't get surprised over how much it will be.

Thanks again for all the responses good to know what is required and needed in the end there have been some very helpful and insightful answers and I will no look into more info about cr1...cr2...k1...k2 and H1B visas and make my mind up from that...Thanks

Not all J-1 visa have the 2 year home residency requirement. The ones that have that requirement are (1) you were funded by the government (e.g. you are part of a Fulbright program in which teachers from another country go to the US to work temporarily), (2) your discipline is in the skill list for your country but usually this is for those pursuing higher education.

 

Anyway, all I wanted to say is that not all J1s make you bearer of the two year home residency requirement. It depends on a few things like what I mentioned.

OP, based on what you have listed out as priorities to work immediately and having your children with you when you 1st come over, the best visa that would fit would be the CR1 and CR-2's for the kids. Immigration is not an easy or cheap process to go through and it will be stressful but it's worth it in the end to be with your loved ones. Your patience will be tested and so will your wallet. FYI, medical insurance may be paid by employer, private is very expensive. US spouse or fiance would be responsible for your\kids finances.

After reading all this I think the best thing for you to do is to get married and for him to petition you on a I-130 Visa, it takes a little bit maybe a year or so but once you are done with the process you can start working as soon as you receive your SSN.

Hi Pristine, yes seems like this is the better option...I have immigrated to NZ many years back but that was with no kids so yes I'm aware that it costs and can be stressful...will take it as it comes :)
