Thanks for the advice guys, i will do it myself and forget the lawyer idea. I do however have a question about question number 12 on the i-129f. I debated waiting til jenifer was in the US before sending the forms in. But question number 12 seems like a trick question. i mean it asks if your fiance was a stowaway or entered without inspection. Neither of those pertain to her because of her valid visa but does it look bad if you answer that yes she is in the US at the time im sending this in? Is she supposed to be in her own country at that time or whatever? I also thought of sending it in just days before she arrives here so it wouldnt be a problem at the POE and technically thats not lying on question 12 since she wouldnt be there until after i had sent it in. I just hope we arent sneaking around or anything. opinions anyone?

If she is in the US at the time of filing, then you say yes. You say she has a valid visa. If it is a visitor (tourist) visa, then you write "visitor". If she is on a student visa, then you write "student." If she has a visa, unless she is from Canada, she will have an I-94 stapled into her passport. Write the I-94 number into the space provided, along with the arrival date and expiry date.

There is nothing wrong with her being in the country at the time of filing if she is in status (which she is, if she has a visa). The only limitation is that she will have to leave the US at the end of the process to attend the interview at the consulate in her home country.
