Applying for B1 while I-129 is processing

My I-129 is currently under Premium Processing, the 15 days window will end in 10 days, but I have to be in the U.S. for an important business meeting very soon (just meetings - so no work visa required) and can't afford to wait 10 days + appointment delay + post delay (for passport), and I'm thinking about picking a B1 interview at my embassy right now (should be fairly easy).

 

I did not mention any I-94 on my I-129, would it cause any problem if the USCIS officer treating my I-129 saw that I entered the U.S. on a new B1 while my case was processing?

As for the interview part, I have documentation of my meetings, I should be able to prove them my sincerity with no issue, I am just afraid for my pending I-129.

It shouldn't be a problem because their system will likely have the info on when you applied for the B1, which is after the submission of I-129F. On top of that, date of issuance will be on the B1 itself in your passport and the new I-94 will show your entry date. Everything will point to the B1 application and entry after I-129F filing.

They might not give you the B1 if you're not able to convince them that you're really going there for work. It's 50/50. Can't be sure till you try to obtain one.

It'll be up to you to convince the officer you're not trying to game the system with a B1. Not USCIS, but the embassy CO.
