Okay, thank you. Oh, I thought I had to file my husband's physical examination along with the packet. Or, at least I was told by the lady at an agency that handed me the forms.

Depending on why the I-485 is denied, refiling may not be possible...only trying to appeal the decision. You can do the I-130 first and then the I-485, but concurrent filing of both forms is available and that is normally the suggested course. The I-130 does not grant any legal status or authorized stay while it is pending, so if his F1 status is terminated or expires while that is still pending, he would be out of status. The I-485 would grant authorized stay while it is pending, so normally concurrent filing is preferred.

I wanted to ask because I'm just worried of the "what if," especially if we don't provide sufficient evidence or our forms doesn't seem to be filled out correctly. However, if the I-485 is approved, does that indicate he can remain in the U.S. while the paperwork is being processed?

 

Thank you for the well explained information, I'm hoping to go with the concurrent filing. I am very nervous about this whole procedure, and I'm sure anyone would. When sending all the documents together, would you recommend sending them in a very large envelope? Or is there a particular type of envelope I should use? 

 

Thank you you again for explaining this to me. I have read on the USCIS website and other sources before, but I still feel a bit iffy on the information since I'm not sure if I'm understanding them to the best of my knowledge.

Right, it's good to know what can happen. But I'd say (for your own sanity) not to worry about that. Note that I said that's if the I-485 is accepted and denied, not if you make a filing mistake and it gets rejected and needs to be resent. If the I-485 is approved, he will get a green card and can stay. Note that they will process the I-130 first still.

 

Not really...just use common sense. A Priority Mail document sleeve is probably sufficient (and only costs like $6 or so to ship), but pretty much anything is fine. Stapling isn't recommended, but paperclips and such to help organize the papers are fine.

To anyone who could answer this question: 

 

Not sure if I should start a new topic or not, but I am just filling out the I-130 and I feel a bit slumped. I have to fill out information about my parents. Does anyone know... when it says the city of residence and country of residence, does it mean where they are currently residing or in regards to their birth place? It's for clarification purposes, and I'm thinking it's the prior.

I hate it when people post stuff with the intention of deceiving people. You don't know why you one is struggling to pay the fee. They have a fee waiver for a reason. The author of the thread didn't ask on I-130. he/she asked for I-131 and 485. As per USCIS, these forms are eligible for a few waiver. https://www.uscis.gov/i-912. Just click on the"special instructions" tab to see the list of eligible forms
