From K-1 to Permanent Resident Alien

Please accept this form I-485, application for adjustment of status from fiancé K-1 visa to permanent resident alien status. Further, I am applying for a work permit via form I-765 Application for Work Authorization.

I was married to (name), a USA Citizen, on March 23, 2007

I changed my name to (name) on account of marriage that day

10. Copy of my Philippines Passport (expiration date February 23, 2010)

11. Copy of St Luke’s stamp on my passport

12. Copy of Guidance Certificate CFO from Philippines

13. 4 passport size photos: 2 Passport photos for I-485 and 2 for I-765

14. Immunization records (my physical was completed in Philippines as K-1 visa process)

15. Letter from Social Security Administration showing I applied for Social Security number.

16. Copy of my I-797, Notice of Action II29F, Approval Notice dated September 11, 2006.

17. Form G-325A Biographic Information Sheet completed

18. Form I-864 Affidavit of Support with supporting copy of 2006 tax return

19. Certified copy of (husband's) divorce decree from prior marriage

20. Copy of (husband's) passport and entry stamps

21. Form I-765 Application for Work Authorization.

I haven't done my AOS application yet, but it looks pretty good.

I would add evidence that your marriage is bonafide (i.e.) Joint bank account, joint car/medical/life/house insurance, joint Costco account, pictures of your wedding, pictures of you guys at home, etc. This will help them see that it's a legitimate marriage.

QUESTION: Where does it ask for copies of the US Citizen's passport? Maybe I missed this...can you please tell me where it asks for that?

it doesn't, and to be honest it doesn't even ask for a cover letter. In one of the posts here from a previous USCIS officer, he stated that anything not requested gets shoved to the side. Another poster said cover letters just go straight in the trash.

You are correct in that you don't need the supporting evidence until the interview.

Maybe someone else can give input regarding the US Citizens passport. I haven't seen anything on here that clarifies one way or another.

As for the bonafide marriage info, it's my opinion that a rock-solid application can only help your changes of getting approved quickly. There's a rumor around VJ that cases that meet a specific criteria don't have to attend an interview. I don't know for sure if that's true or not, but I want to aim for that. I am going to be putting evidence in my initial application. You can definitely wait to present that information at the interview if you feel more comfortable, though.

Evidence of marriage doesn't need to be submitted in this application. Everything looks OK from what I see. Good luck! :thumbs:

I work in a different field, similar type of job as the people reviewing job apps - we review ppw and if it's not needed/requested, it gets trashed. All your evidence and the cover letter is probably thrown in the garbage, so I just sent what was necessary (husband is on a tourist visa, no chance of approval without an interview).

I have annotated the following:

* For # 9 - Two copies of the I-94 are required (1 for the AOS and 1 for the EAD)

* For #11 - Providing a Copy of St Luke's stamp on my passport is voluntary and not required for neither the AOS nor EAD applications. The CO is not concerned with whether or not SLEC stamped the beneficiaries passport.

* For #14 - By immunization records, you mean the DS-3025? If so, your immunizations records are incomplete because the TD shot is NOT administered/available in the Philippines. RECOMMEND getting the TD shot and having your records transferred to the I-693A by a civil surgeon before submitting the AOS and EAD applications. [CLICK HERE] for the USCIS Civil Surgeon Locator. NOTE: Some civil surgeons try to impose another medical exam, for K1's that is not necessary because the medical exams are good for one year, per the AOS instructions. You probably already know this, but I just wanted to put it out there (just in case and for you to beware with some civil surgeons).

* For #15 - Providing a Letter from the Social Security Administration showing you applied for Social Security number is voluntary and not required for neither the AOS nor EAD applications. You can bring a copy of your SS card to the AOS interview (if applicable). However, in our case, the CO was not interested and did not care about the letter from the SSA nor the beneficiary's SS card .

* For #18 - RECOMMEND submitting a copy of your W2 (if applicable).

* For #20 - Providing a copy of the petitioner's passport and entry stamps is voluntary and not required for neither the AOS nor EAD applications. However, you SHOULD go ahead and SUBMIT a copy because if you are scheduled for an AOS interview, the CO may ask for a copy (at least in our case, the CO did request a copy).

Hope this helps and remember these are only suggestions/recomendations.

You need to get the Vaccination Supplement (I-693a Vaccination Supplemental Form) filled in by a Civil Surgeon.
