I'm looking for NVC insight after thinking I had received terrible news this past Friday night, when I finally got through with an NVC phone call.

 

The agent told me there was no record of my documents being received, but I know the documents were emailed by my lawyer on the 13th of March.  She even forwarded me the standard email reply which stated they got an email from her.  Is it normal for the agent on the phone not to be able to see the documents after nearly 3 weeks of the docs being sent?

 

He said they might have been sent in too large a format, but my lawyer says otherwise.  As a precaution, my lawuer resent the docs on Saturday Morning (4/1).  

 

Did my husband and I truly just lose nearly a month thinking the docs were with the NVC?  My husband is livid with our lawyer, but I'm trying to find evidence that everything was done correctly from the start...

 

What should we be anticipating from here as far as wait time/ time to see that the NVC has our docs?  Is there something more we should do?

The documents should formally be sent by you. All documents sent should be scanned and copied incase the first documents get lost or don't make it to the NVC. Also you should use a courier that provides tracking services.

Thank you!  We have the scanned copies bit covered, since they were emailed. :)

If they were emailed the should definitely have it in file. If I were you I would request an expedite because the NVC being extremely negligent; the reason I would request the expedite is they essentially misplaced your email which includes vital personal information. On top of that this delayed your process up to and over 1 month. All of these are significant reasons to request an expedite and it doesn't hurt the try. The worst thing theyll do is say no. Also, if you request the expedite, the Embassy is the one who decides to accept or deny. I have seen a very similar situation like this where the party ended up getting approved for expedite for reasons similar to yours.

 

Just be sure to include a timeline of dates and events of when you started the process and when the NVC misplaced your files. State the hardship this is causing you. Be very very specific. If you want the expedite email,  message me and ill be glad to assist you

Elaborate on the "standard email reply", you mean the NVC sent her an email?

 

If so, that is your ticket to prove negligence on their part. If they confirmed receipt of the email a month ago, they can't deny having it now. If it was a letter from your lawyer stating "We have sent in the documents", but without an NVC confirmation at that time, then it will be difficult.

NVC has been getting sloppy, most likely because of the high volume of cases they deal with, and their ever-increasing wait times. We emailed our documents (also using an attorney) and 2 weeks later they still did not have any record of our emailed documents being received.

 

I think they dont register the documents as received until they actually open the emails to review the documents. A few days after the 2 week mark, we received a checklist for items we had submitted. We submitted the exact same email with the documents again and then a couple days later we had case complete. No idea what happened the first go-around, but fortunately someone with at least a minimal level of competence was able to review our case the second time and see that everything was in order.

 

They are swamped with cases, so there are items that are missed. It is a good idea to call NVC constantly to check on the status of your case. A month does seem like a lot of time, as most cases handled through email are reviewed in 2-3 weeks, so it is definitely good that you checked with them. Now that you have resent the documents, I recommend calling NVC every day to follow up on their progress. Maybe in that time they will process the original email that was sent in, who knows?

The silver lining is no matter how slow they are with electronic processing, they will never take as long as they do with "snail mail" processing. Took us 10 weeks to get a checklist, and another 11 weeks for them to look at the single piece of paper they requested.

 I have sent my documents seven times. And when i was about to send my documents for the eighth time this the supervisor  called me and he said we did not receive it send it send it send it I said is there something wrong in my brain I have sent many times he said hold on a second.  He looked and he looked and he found the document and he uploaded to the file and he finalize the case within five minutes. 

 You always have to call and keep calling and you should ask to speak with the supervisor I was about to freak out on them

Wow, glad to hear they were finally able to get that one sorted out. They are so sloppy over there at NVC! They also could somehow not find our documents either, then suddenly a couple days later we had case complete. So frustrating, but glad that the wait time is not long with EP and that we both have case complete. :)
