Well, I answered no. K1 is technically not a immigrant petition, and I interpreted it as prior to the underlying petition which is already mentioned earlier on the form. BUT, this is one of those questions where I think it doesn't matter if you say yes or no. :)

In all honesty, for the K1, it doesn't matter. The question is more relevant to other visa types. But, the correct answer is yes. The i129F petition HAS been filed for you.

I disagree... the question is "immigrant" petition. The i-129f is non-immigrant, so as to be "correct"  I'd stick by "No", but again it doesn't matter.

As confusing as it might be, the I129F is a immigrant petition, while  the K1 is a non-immigrant visa. Haha, we can obviously go on forever ;-) Bottom line, Yes/No will both be accepted as answers on the ds160 (because the question is irrelevant for K1 processing).

Where have you read that? The instruction for i-129f speaks of nonimmigrant petitioner. It's a dual intent visa processed at the immigration unit yes, but it is non-immigrant. You can't have a immigrant petition for a non-immigrant visa - the petition determines CoA (Class of Admission) for which the beneficiary is eligible to apply.

 

Anywhoooo....... yes we certainly can go on for evverrrr :P As I'm sure you've seen, many have discussed this on here before :D
