Hello,

 

I will be applying for AOS marriage green card. I have been having issues with finding a sponsor. I finally have an option but I want to make sure it will work and that I will do everything correctly since I do not want to pay 1500 dollars for a lawyer(thats how much the guy i found charges). My wife`s sister who I am considering for sponsorship will graduate this may and already has an offer letter from a company. When my wife submits the I-864 she will have her sister as a co-sponsor. What documents will I need to make sure no issues arrive. I was thinking of waiting until she gets her first pay stub and sending that along with her offer letter as supporting documents (she did not make much as a student so tax returns and w-2 will not show sufficient income. Will the one pay stub and an offer letter be enough evidence?

Question 2: as far as proving that the marriage is real I was thinking of making a joint banking account for my wife and I. Also, getting a couple of affidavits from her family or friends. How do I get affidavits? Do I need to go to court and have a judge or an official to sign to make it official or do unofficial affidavits also count? Will those 2 be enough?

Sounds like your wife's sister is not a good candidate to be a cosponsor as of yet. It is not just having a job but also established work history. One paycheck may not cut it. It is recommended to have at least 6 months of pay stubs. 

 

May be best to find a cosponsor with work time at their job. Or at least wait until your wife's sister has been there a few months.

My Visa in my passport is expired(I'm still on college and my i-20 is up do date). Therefore, I wanted to get the green card process started and hopefully getting the advance parole so that I can go home this December without worrying about renewing my f-1 Visa. Once I submit all the paperwork how long does it take for me to get the advance parole allowing me to travel? Her sister is my only option so I wish that could work... Does she have to submit the past 3 years of tax returns even if that will show low income? How long should she be working before she can sponsor me? She will be hired in May and she already has her offer letter and she will make more than enough.

1. As @NuestraUnion mentioned, just the letter and a paystub will not be enough. She needs to have worked for at least 6 months to be able to show a stable income for the proof to be strong enough, even then there is sometimes problems when there is no prior work history at all.

2. It takes roughly 3 months to get EAD/AP - currently it's taking more like 3.5-4 months.

3. She needs to report last three years (19a-19c) and send in the last year (can send last three but last is required) - if she has not been required to file she'll need to provide a non-filing letter from the IRS.
