Hi All,

I haven’t been on here for a while. It’s nice to see so many approvals at VSC. Congrats!!

I’m hoping CSC will pick up soon. We filed there in April and no update received except that our case was transferred to our local office back in February.

We won’t be filing the N-400 for a while but are planning to get a stamp soon.

No you’re confusing the 90 window with the time we can file the request to remove conditions and how we got a 1 year extension while processing the case.

My husband couldn’t schedule the appointment until 30 days of his extension expiring. They then stamped his passport to extend the extension but it’s only for 6 months at a time which is October.

If he isn’t approved by September he will have to make another appointment for another extension. Our hope is we can speed things up with the N400 simultaneously being filed now.

We got an update this morning on the N400 that they received and will review and to expect another biometrics appt in about a month. They also estimated completion of the N400 case to be April 2019

Good point. Do you know if a state ID or drivers license can be renewed with that stamp?

I’m would assume so... without the stamp in passport you are out of status

Yep, you can. I got a 1 year stamp and went to get a new DL (since I moved states and needed to change my last name). I actually got my DL for 8 years :)

Here in NJ they give you a DL according to the expiration of your GC. If you have a gc valid for 2 years then they’ll give you a DL for 2 years. If you have an extension letter valid for 1 year then they only give you one year. It’s so annoying having to go to the dmv so many times to renew your license. I wish nj were like other states. Hopefully now with a 10-year gc they’ll give a license with full validity.

without stamp, you are still in status

The stamp extends the extension. If the extension expires without another extension you WILL be expired and out of status according to immigration officers we spoke with recently.

Your stamp or extension letter may expire but your status in the country is still legal. The letter or stamp is just proof of that status.

in uscis system, you are in status, and legal,  as long as your i-751 is pending,  it doesnt matter if you have stamp or that stamp expired

I’m not saying anyone is here illegally while waiting with expired extensions. Everyone is legal while the case is pending until a decision is made.

However, if you have to prove your case is still pending an expired green card and an expired extension gives no proof. So to prove you are awaiting a decision we get extension letters and then follow up stamps.

If you never have to prove anything to anyone then sit and wait. Good luck trying to take an expired extension into a DMV office or return back into the United States.

If you’re waiting with your case in the CSC I suggest getting your stamp to save the hassle in the event you need to prove your situation.
