Hi,

Okay my husband and I will be filing our removal of conditions petitions in about 10-12 days from today. So far I have all documents except for the affidavits and I haven't written the check yet. My petition has about 100 pages give or take. Please review it and tell me if I have enough evidence or if I have forgotten any evidence. Also could you tell me with the following documents below if I should add the affidavits (I don't have them done as of yet) and before I am told to read the guide I know they are optional. I am just looking for opinions.

Front & back copy of green card for beneficiary

Copy of Alabama driver’s license for beneficiary

Copy of USC identification

Copy of Welcome to US notice

Just a few things:

Complete and signed Form I-751

Front & back copy of green card for beneficiary

Copy of Alabama driver’s license for beneficiary - what many do is make a copy of both dls to show same address, so include the copy of your spouse's driver's license

Copy of USC identification - what is this?

Copy of Welcome to US notice - is this the USCIS letter after AOS approval? if so, it is NOT needed, doesn't serve as proof for legit marriage

Copy of marriage certificate in Arabic & English - if this has already been submitted with the AOS paperwork, it is not needed, as they only want new proof

Power bill

Cable/Internet bill

Home phone bill

Cell phone bill

Letter from bank showing beneficiary as a joint account holder

Bank statements

Copy of life insurance policy showing my husband as beneficiary

Statement from Health insurance Company showing my husband as a

Anyway, remember they want to see primarily items that carry both your names, so if some bills don't show both names, you might want to consider excluding them, to keep your package in a reasonable size. Overall your list looks good.

How could this be 100 pages? Anyway, if you bear a child or more to your husband, copy of birth certificate as stated in the I-751 instructions. Also as stated in the I-751 instructions, affidavits from at least two people.

Affidavits are not required, as the OP correctly stated.

To the OP: to affidavit or not to affidavit has been discussed at length many times -- you may want to do a search to read some of the old posts if you do not get responses/opinions quickly enough on this thread. My personal preference is NOT to include affidavits unless the rest of the evidence is weak. We did not include affidavits and were approved in 2.5 months from submittal. Good luck, your list looks good.

P.S. Not sure if you were planning on sending only one bank statement, one utility bill, etc. My suggestion is to send a selection of statements covering the period over the last two years, maybe one every 4 months or so. This shows continuity of the marital relationship from throughout the last two years.

Anyway, if you bear a child or more to your husband, copy of birth certificate as stated in the I-751 instructions. Also as stated in the I-751 instructions, affidavits from at least two people.

Some evidence must be given, but the type of evidence is optional. With so many other documents, affidavits seem unnecessary. Any birth certificate for a child of the couple, however, would be strong evidence and should be submitted.

this is not necessarily true.... I think it is good to include a few things that have just one spouses name on it, specially for people who might not have a lot of other evidence.... I submitted a few bills with just my name and a few bills with just hubby's name....

I just submitted one copy of each recent utility bill.. one copy of a recent bank statement...

i also only included the page that had the names on it.... like I didn't include the whole bank statement just the page that all the pertinent information on it.... Same with the tax forms... I didn't include all the pages just the one with our names on it....

I think your evidence list looks fine and dandy! As everyone has stated, you don't need affidavits, and by the look of your list you have it all covered without them. 100 pages? Wow, mine was 30 including covering letter and forms and I had no problems. Good luck for a speedy process. :thumbs:

this is not necessarily true.... I think it is good to include a few things that have just one spouses name on it, specially for people who might not have a lot of other evidence.... I submitted a few bills with just my name and a few bills with just hubby's name....

I'm basing my comment about only submitting items with both names on the I751 form instructions. I would only include items with one name on it when I wouldn't have anything else.

Anyway, regarding excluding pages from documents: Based on an RFE text copy that was posted here recently, it is also not wise to submit incomplete items - like leaving pages of the tax return out, or just submitting pages with name only and excluding the rest.... It appears that USCIS wants the documents complete without anything missing. I wish I would have known this when I was submitting.

I just want to quote Tweety...

a lot of people don't feel comfortable sending complete bank statements ,etc showing all the account information and balance etc..

but since the RFE's state that they want complete documents, showing balance etc...that answers our questions...

I tried to send mine as complete as I could...I wish I have known that too

...HOwever I'm getting prepared in case I get a RFE....still collecting copies ...just in case...

Copy of marriage certificate in Arabic & English - if this has already been submitted with the AOS paperwork, it is not needed, as they only want new proof We gave our marriage certificate to the US Embassy in Cairo

I stand corrected - 9 of the items on your list do include such words as 'joint', 'dependent', or 'beneficiary'. Those items are probably good, useful evidence.

For the other items you do not mention how the item ties you and your spouse together, so I couldn't say if they are useful evidence or useless evidence. For example, "Power bill" - nothing in that 2-word description of the item indicates whether it's useful to your case or not useful.

All of the utilities bills and bank statements are in both of our names, I also included a copy of our health insurance claim report showing charges and payments for both of us by our health insurance company. The only items that are not in both of our names are the mortgage and the water bill(both are in my name only) so I didnt include them, this is why I included my photo identification along with my husband's driver's license as proof of same address. I included some bills/bank statements in 6 month increments while other bills I provided in 2-4 month increments. I included our marriage certificate (which is 21 pages long hence my package being 100 + pages).

I have photos of me and my husband together, with my grandparents, with my parents, with a friend or 2, and a couple of wedding pictures, etc.

In writing this post I mainly wanted to know if my evidence was strong enough without the affidavits in the opinion of VJ viewers.
