Hey, I'm from Virginia too. We are on the same boat. I filed at 4/24, no EAD updates since then (121 days already), GC ready to be scheduled since June. So frustrated:(

Call USCIS and ask for a Tier 1 or Tier 2. It is actually in the USCIS website that you can start calling for an update on the EAD as soon as your application hits the 76th day of being active.

Make sure that the supervisor puts a service request on the system under "Beyond Normal Processing Time".

yayy! i just got an update just few minutes ago that card was mailed to me...and yep AP is still "case was received"... must've been the eclipse lol'

AP status will remain as Case Was Received as the AP and EAD are just in 1 card.

Congrats! :)

Hey thanks for responding, I actually did put request 2 times already and called many times. Got the same general answer from USCIS each time. So I feel like I could do nothing but wait.

Did you talk to a supervisor or just a regular rep? Tier 1 and Tier 2 have more authority and can do certain things that a regular agent couldn't do. Try to call back and follow up on the same SR. I put 2 SRs and they answeres me on the 2nd one. Right before they answered my 2nd SR I even put up a request to have my case expedited due to severe loss of finances since only one person is working etc., by the time I received the mail of them asking me for evidences to support my claim for expediting the case, the same day I got the mail for the NOA2 of my EAD and AP.

I have called I think 4x. I was only assisted properly by the 4th call. And I learned that I was given a wrong info by the 2nd rep I talked to.

Don't stop calling. You're already waiting too long.

Based on my experience, an Infopass appointment won't do you any good. If your case is beyond 106 days (current average VJ processing time), your next step after a service request should be to have your USC spouse contact their representative in Congress to have an inquiry submitted.

Speaking of that, I spoke by phone with my representative's office on 8/16 and they put in an inquiry the next day. I followed up with them yesterday. Their only update was that my wife's case was "with an officer" which was basically the same status update I received at the Infopass appointment on 8/9. However, given that there's now a congressional inquiry on record with USCIS, I've been told that we should have a decision by the end of this week. Fingers crossed!

Thank you, your report on the infopass appointment was very helpfull, i believe i'll follow your advice. If nothing happens until the end of the week we're contacting our Congressman.

Best of luck to you.

Do you think it's our state office that is backed up? I thought NBC had my EAD/AP case...is there a way to know where our case is at the moment?

I will try this tomorrow, thank you. My fear is that because my last SR was completed on 08/10 they'll say i have to wait and refuse to transfer me to a Tier 1 or 2...

Can you tell me on which page you found that statement? The only thing I've been able to find is in regards to placing a service request. Beyond that, repeatedly calling probably won't cause USCIS to process a case any faster.

I've heard that the call center reps (Tier 1) and even the ISO's (Tier 2) are hit or miss. So your advice to call back is sound.

I'm glad you found it helpful! I don't want to discourage people from making an Infopass appointment but I want to be sure people have reasonable expectations before possibly making a very long journey only to be told the same thing as they were told from a service request. My only suggestion is to be polite to your representative's staff -- they have nothing to do with your case's delay and are actually on your side fighting for you. Give them as much information as possible and make sure to include all tracking numbers (alien number, receipt/MSC number, date applied, NOA1 date, etc.) so they can have an easy time talking with USCIS.

Thanks! I'm very familiar with that page. What it says is "You can submit an inquiry about your Form I-765 if your case has been pending more than 75 days." Basically, you can submit an SR over the phone or online, but calling repeatedly requesting an update won't improve your case's processing time. (In fact, it may slow it down.) I chose to submit the SR online and got a reply in about 12 days (see my signature). It seems that the turnaround times for SR replies vary widely, though. So yes, you can submit an SR on the 76th day but you'll have to wait until they reply to call again.

I made an SR in July 3rd and another one in July 18 even tho no action has been taken regarding my first SR.

The July 3rd SR is still untouched, they managed to work on the July 18 SR after 9 days. My request for expediting the case was in July 21.

I was told by a rep that once a request to expedite the case has been created, the SR registered is no longer of importance. But on the same day that I received the mail from them asking for more evidence proving the reason for me filing for expediting the case, I also received the NOA2 for my EAD and AP.

They're kind of confusing at times but you just have to find the right person to talk to.

How do you do that? Keep calling. I also try to get the agent names and agent IDs of each rep I talk to. I had spoken to a guy called Cesar, another one called Lester, a lady called Courtney and fella named William, but only Lester and Courtney managed to help me go through my concerns about EAD updates. Mine got approved by the 107th day of being active. I started calling them on the 81st day.

I hope yours gets approved soon. :)

I almost did this. What I was planning to do at that time was fax them a copy of my husband's paystubs for the past 3 months and then copies of the bills: car insurance, rent/mortgage, health insurance, receipts from groceries for the past 2 weeks or so showing approximately how much we are spending to buy food and other needs, phone and internet bills, utilities, credit card bills; basically showing them the comparison of how much is being earned VS how much is being spent.

You will be receiving something in the mail about the request to have the case expedited and where to fax whatever you're sending. Wait for the letter and decide from there.

Best of luck!

Hello Everyone!

It's been a while since I've posted...im filing from Virginia

Finally after 116 day, 2 Sr's and a request to have my Ead expedited due to severe financial loss my card went into production on August 18th and change to " card was mailed to me" today. Hopefully I get it by the end of the week 😊

My advice is to be persistent and keep calling, put in those service request and ask to expedite!  My case was approved after I asked to expedite...the same day.

Congrats to everyone who received there EAD/GC already...

The wait continues....one more lap to go. This process takes fair & patience. Hang in there!♥️
