Finally got all the relevant info off to my local congressman today, albeit a Saturday. Hoping for some kind of a quick turnaround so I can get working.

Filed SR EAD expedition with USCIS, stating 'severe financial loss to the individual' 6/6
Raised Expedite request with congressman 6/8

Hi all, looking for some advice...

 

I was on an E-3 visa & submitted an AOS to green card due to marriage. I married on 3/17 and my E-3 visa expired at the end of March (due to cease of employment - company was acquired), as such I currently can't take further paid employment until I get my EAD.

 

USCIS received my I-485, I-765, I-130 & I-131 forms on 4/25 per the receipts. I haven't heard anything since and there are no updates on 'my cases' on the USCIS website. It seems that some people that filled the same time as me already have their EAD. I live in NYC & I've heard it can take a little longer here, but I've read of others switching from E-3 to green card in NYC that applied after me & are much further in the process.

 

From my understanding I can submit an SR after 90 days (around 7/25) - is there anything else that I can do?

To clarify from above, my E-3 visa had a grace period which expired on 4/30, so I was in status when I received the receipt from USCIS.

You don't have to wait 90 days to submit a SR, you should probably just try it.

Well actually you can raise a SR after 75 days of your receipt date. Also if you have a good reason you can try to expedite the EAD/AP (before 90 days).

Thanks for the replies! I'll try to raise one tomorrow. I haven't even had a bio-metrics appointment yet...

 

It doesn't look like a have a valid reason to expedite, I just really need the AP for December.

 

Edit: I'll keep you all updated in case anyone else is in my situation.

i really think your process is way different than people who adjust based on family coz most of us had our bio-metrics within 3 to 4 weeks of filing... and i think the wait times are different too coz as far as i know E-3 visa is a special visa category for Australians to do business in the US and there is an inherent condition with that visa that you finally intent to go back to Australia, so on applying for LPR you might run into trouble... I think they should have a specific section for E-3 visa-AOS on here to avoid confusion... i really don't think you will find much help under this particular topic but good luck to you anyways and you might find these links useful...

Timeline so far:

May 23rd    : Sent i-485, i-130&130A, i-131 and i-765 along with supporting documents at around 6PM via UPS next morning delivery.

May 24th    : USCIS received packet at 10 AM.

May 31st    : 4 texts and emails NOAs for all the applications and signed up for case status account.

June 2nd    : NOAs in the mail.

June 9th     : Bio-metrics appointment notice dated June 2nd. Appointment scheduled for June 20th.

June 12th   : Bio-metrics done, Walked in with an infopass appointment that nobody asked for. They didn't even ask why i was coming in early.

                      The person who dealt with me was very nice and welcoming.

July 3rd       : At 11AM received an email saying your case status has changed to interview is scheduled for August 2nd...

August 2nd : Attended interview was approved on the spot... IO was nice professional and polite but not friendly...

August 10th : At 2PM received my Green card in the mail!!!!

sorry i missed the fact that you are adjusting through marriage... so i guess you are in the same boat as the rest of us and you should raise an SR about your bio-metrics first and then the EAD/AP coz its taking too long for the bio-metrics especially... sorry about the last post again i swear i saw the words i-140 in there somewhere... lol... :rolleyes:

 

P.S. you will most definitely get AP or maybe even your green-card by December unless something goes horribly wrong(with the AP that is) so don't worry about that too much...

Hey everyone,

I received my combo card today (eh, yesterday; checked my mail today). It's the old design. :D 

However in place of the signature, it says "Signature Waived". Is this normal? I distinctly remember signing at the biometrics appointment as well as on my application. I have an awfully long signature, in case that could be the reason. :wacko:

Congratulations!

The whole 'signature waited' thing sounds odd, although I don't suspect it's anything to be worried about in terms of validity. It might raise a few eyebrows with anyone not in the know, but in terms of reentry to the country it should be fine, surely?

 

I'm sure someone here has a good idea or past experience with a similar case and what it means.

 

It's got me wondering though, so I think I'll look it up.

congratulations... i dont think anything thats waived would be a problem especially coming from USCIS... now the final wait begins, huh?

You're right. I looked it up and found out the same: if the line (i.e.  I-765 form field for the signature) crosses the signature, the system rejects it.

Thanks! Yep, now the actual wait begins; don't know how long that's going to be. It does worry me to see some November and December filers waiting, let alone those who have filed in 2017. :unsure: Oh well it is what it is. :jest:

hopefully its not too long of a wait... i used to worry about seeing December 2016 filers waiting for EADs but i got lucky and my interview is scheduled for August 2nd so now its the tension of everything going smoothly on that one day that can decide my life lol...
