They returned the whole package to me, nicely stapled and organized. I only needed to add G-1145, a copy of the NOA1 for my I-130, a copy of the rejection letter; for the rest of the package, I left them as how it had been.

In this case, I think you should put it as No. That's what I think. If you put Yes, and your wife doesn't have any record for that such as a copy of an old work permit, they'd reject your application again.

Yeh I thought so too. 

 

I wouldn't think initial rejection is the same as denied.

 

I shouldn't need to do cover letter correct? or it won't hurt if I list down what we have in the package?

This is not necessary. They did not ask for my marriage certificate and the biometrics letter says to bring the letter only and proof of ID. I did take my marriage certificate with me because my name changed so the name in my passport and the biometrics letter were different and even then they did not ask me for it.

Also this is not specific to K-1 visa at all, a lot of people are adjusting status based on marriage that have not entered the country on a K-1.

I think I am also a little annoyed that my marriage certificate got a little wet in the corner because it was a rainy day <_<

When you get your marriage certificate from the city clerk, it is already a copy. It's called a certified copy of the marriage certificate, since it is from the official source and it has the official seal on it.

You can send that certified copy, or make a photocopy of the certified copy for AOS purposes.

I got two certified copies from the city clerk after we got married and sent one of those certified copies with I-485. For I-765 and I-131 packages, I included a photocopy of the certified copy.

The second certified copy I keep at home to use as necessary. I carry a photocopy of it with my passport to use as a name change document. I would take the certified copy with me to travel and bring it along with my passport.

I am under the impression that when the term "original marriage certificate" is used in these discussions, people are referring to the one obtained from the county or city clerk days or weeks after the wedding has occurred, and a "copy" is a photocopy of that same document. 🙂

I just wanting to actually say hi on this forum, I've been using the March filers forum since i sent my package, but I actually sent the package at the end of march, so most of my process has been taking place from April onwards, so actually thought I'd come say hi to you guys :)

Hi @emchappie! It's good to see you here again. I used to be a March filer, but USCIS had rejected my application, and I resent it nearly towards the end of April. So I guess I belonged to both forums lol. The March filers have been receiving good vibes; I hope we will be next :D

It was a very pleasant experience! All the staff were extremely nice and friendly at the San Antonio office, and I was in and out within 20 minutes.

It depends on you. I didn't include one when I resubmitted. However, if you want to make sure they know what included in your application, you should attach a cover letter.

Even though the bio letter doesn't mention to bring it, its important to have it with you because its the proof of legal name change, if you had your name changed of course, and spare you the time waisting in the manager's office for a name check. Hahaha yes it's for everyone adjusting from marriage based.
