So, the timeframe is within 30 days from receiving your NOA? Is that the NOA for AOS or EAD?AP? I ask as the USCIS phone app has different dates for the different forms having been received compared to the 'days active' number.

Currently, all three (AOS; AP; EAD) have been active for 34 days, yet the AOS dates from May 2nd, whereas the EAD and AP date from April 18th.

Where am I supposed to counting the 30 days from; just the AOS?

You're welcome...my receipt notices are dated May 2nd, so basically we're within their(USCIS) time frames. hopefully we wont pass that 30th day mark...the lady said there's alot of factors we need to consider regarding delays, as we already know 1) the person handling our case 2) the amount of workload 3) backlogs at the offices, etc..... at least we are giving them a nudge on our cases...to let them know we are waiting....patiently i hope...

So I called the USCIS this morning and the tier 2 officer gave me a receipt number and told me my I-765 was rejected because we sent an incorrect fee but how is that possible? My wife sent her I-131 and I-765 included in the AOS package. So the I-131 and I-765 should be free.

did anyone ran into the same problem with me? Also how long does it take to get your rejection letter? Any info will be appreciated!

You are not the only one having this horrible experience. Some VJ members experienced the same thing, too, and obviously, it was USCIS' mistake. I received my rejection letter 3 days after the Notice Date stated on the form, but the Received Date was 16 days before the Notice Date. So I think it depends on the notice date.

01/09/2011 - Arrived United States

11/15/2012 - Officially dated my husband

11/30/2015 - Got married

03/15/2017 - AOS package sent but got rejected

04/22/2017 - AOS package re-sent

04/24/2017 - AOS package delivered at USCIS, Chicago

05/12/2017 - Text/Email Receipt received (1 text, 1 email) for I-130

05/13/2017 - Received I-797C for I-485/I-765/I-131 in mail (USCIS couldn't find my record for I-130 approval)

05/15/2017 - Check cashed (I-130)

05/19/2017 - Received NOA1 for I-130

05/20/2017 - Resubmitted I-485/I-765/I-131

05/22/2017 - I-485 delivered at Chicago P.O. Box

May 18th received my RFE response. Waiting again for updates hoping it goes smoothly from here on out. Wife is desperate to start working and just drive a car like a normal person.

I know the feeling! In Pennsylvania, you need at least 1 year of legal status remaining in order to get a driver's license. Because my wife arrived on a K1 visa, that wasn't possible. So now, we wait. Even with an EAD/AP card, she can't get a license.

I had my biometrics yesterday and it all went fine! Nobody asked me about my phone and I was even able to use it to fiddle with while I waited. They were a lot more concerned about crying children. It was in Revere, MA, I arrived half an hour early and was given a number right away. I think it took around half an hour to forty-five minutes in total.

Good luck to everyone else who is waiting!

I think that's all you need to resubmit. My I-485 was rejected because they couldn't find my record for I-130 approval (I know, shame on them). They returned the whole package to me, nicely stapled and organized. I only needed to add G-1145, a copy of the NOA1 for my I-130, a copy of the rejection letter; for the rest of the package, I left them as how it had been.

Good luck to you and your wife! Hope they won't mess it up this time!

01/09/2011 - Arrived United States

11/15/2012 - Officially dated my husband

11/30/2015 - Got married

05/13/2017 - Received I-797C for I-485/I-765/I-131 in mail (USCIS couldn't find my record for I-130 approval)

05/22/2017 - I-485 delivered at Chicago P.O. Box

Why is that necessary? How is that even possible, given that most people will have sent their marriage certificate off as mandatory evidence for the AOS?
