We have the similar timelines. Docs received Apr 26 and they sent out noa1 on May 2nd. Also still waiting on biometrics and I feel like i can't wait any longer. Hopefully it comes in tomorrow. What's your field office? I wonder if that's the cause of the delay

So I called the USCIS this morning and the tier 2 officer gave me a receipt number and told me my I-765 was rejected because we sent an incorrect fee but how is that possible? My wife sent her I-131 and I-765 included in the AOS package. So the I-131 and I-765 should be free.

 

did anyone ran into the same problem with me? Also how long does it take to get your rejection letter? Any info will be appreciated!

You are correct that the fees for your EAD (and AP) are waived if applying at the same time as AOS. Did you include a check for the correct amount? I paid $1225 and all three of my applications were accepted without any rejection letter.

 

I'd follow up to ensure 1) the payment amount was correct; 2) if so, that it was deducted from your checking account and 3) if so, call back USCIS to ask what your options are. I've seen others here mention that if you re-send your EAD and/or AP package with a copy of your AOS NOA1 that USCIS will waive the fee as if it was filed concurrently.

 

Good luck and sorry to hear that you're having trouble. :(

Yes the USCIS already cashed the check of $1225 and i already received my NOA1 letter for I-485 and I-131 so I don't know why the tier 2 officer told me that my wife sent in an incorrect fee for I-765....:(

 

Sounds like there's a mistake on the USCIS part thinking that my wife filed separately for the I-765.

 

What we will do now is wait for the I-765 rejection letter and then send it back again with the I-485 NOA1 letter. 

 

I can't believe that we have sent in everything with a cover letter and the USCIS still made a mistake....

Did you wife file for her I-765 as (c)(9)? If not, then what happened made sense. If you do not file as (c)(9) when filing concurrently, then you are not asking for the fee waver, and therefore still owe the fee.

 

Wait for the I-485 NOA1 (I-797C) and refile the I-765 under (c)(9) classification with a photocopy of the I-485 NOA1.

Ah! Good point. There was someone else here on VJ who didn't file as a (c)(9) and was rejected. I'm wondering if that's the case here, too.

Hi! good morning..so nothing in the mail this morning yet... the nearest field office to me is Reno, Nevada and NBC is working on my case...they did not mention anything in the notices for any transfer of field office. im gonna call them before the day ends. crossing fingers here that they have the schedule

There's no mail scheduled for me today apparently (no notification from USPS) so I guess I'll just have to hope the biometrics notification turns up tomorrow.

okay so i just got off the phone with the kind lady representative and the only  thing that she can tell me is that uscis didn't send anything yet for the bio appointment schedule and that i have to wait it out if it has passed the 30th day mark(told me not to worry im still within timeframe)..so i guess another 7 days wait til i make that call again...oh well...now the waiting continues...

So, the timeframe is within 30 days from receiving your NOA? Is that the NOA for AOS or EAD?AP? I ask as the USCIS phone app has different dates for the different forms having been received compared to the 'days active' number.

Currently, all three (AOS; AP; EAD) have been active for 34 days, yet the AOS dates from May 2nd, whereas the EAD and AP date from April 18th.

Where am I supposed to counting the 30 days from; just the AOS?
