Thank you. They actually rejected my application last month, so I just sent out a new one on the 22nd. That's why I'm so worried. I don't know if they'd accept my application this time. I'm an international student who will be graduated in 17 days, so I need the NOA1 from USCIS in order to stay here legally while waiting for the GC.

You do not need to worry about being out-of-status that much, it will all be forgiven once your NOA1 arrives.

You could also apply for OPT to have status.

I should have applied for OPT by the end of March in order for the EAD card to be sent to me right after I graduate. However, since I had already sent out my AOS package on 3/15, I realized that there was no point for me to go for OPT since the AOS-based would arrive before the OPT-based EAD. It took USCIS almost 1 month to return my AOS package with the rejection notice. Hence, I feel like I'm running out of time. I need at least the acceptance email from USCIS before May 17th in order to show it to my school, so they'll not terminate my I20 after I graduate. It's only 17 days left, and I don't even know if I'll receive anything before that.

Ahh I am sorry to hear that.

I do not get how your school would not terminate your I-20 just because you are adjusting status. Your I-20 is a document that shows that you are a student, and once you graduate you are no longer a student, and thus you are automatically out-of-status for the F-1 student visa.

17 days, under most, circumstances, should be enough time to receive NOA1. Keep your fingers crossed!

Well, I think I put it in the wrong way. The school staff told me that if I show them the NOA1, they'd remove me from the international students list. So, it's not that the school is going to terminate my I20, but it's me who'll be out of status after finishing school. That's why I need the NOA1 since it proves that I'm legalized to stay here even if I'm not going to school anymore.

Got my notifications through email and text message yesterday (Apr 29)! My application was delivered on Apr 25, and based on the timelines I've seen on visajourney I wasn't expecting to get the notifications so soon. Also thought it was kind of weird I got them on a Saturday...? Anyway, I'm glad I'll be able to track my case soon.

I have to agree that you receiving the e-notifications 4 days after your applications were received is relatively faster than most of us here have experienced. Lucky you! 🙂

When filing AOS, it's ignored, not forgiven — it will still be on record.

Keep an eye on your bank account. If you see the check get cashed, you know you're good and you'll receive the NOA1 only a few days later.

I would still say forgiven, not ignored. Ignored implies acting like it never happened. When you forgive something you do not forget the act, just excuse it for the time. Being out-of-status is forgiven for AOS. Not for other circumstances. So for example, theoretically, if she were to abandon AOS and leave the country while out-of-status, when she wants to come back in, those out-of-status days are on the record and can affect entry.

Yay, congrats! I got notifications only 6 days after delivery too, and on Saturday as well, maybe the processing times are picking up!!

Hello Everyone!

 

I downloaded the uscis app to my phone and i was able to track my case today.

Mailed application 04/21

Delivered 04/24

Received email confirmation 04/29

 

Kinda shock of how quickly things have been going so far after reading so many experiences where some people wait forever....i am happy that there is atleast some progress taking place.

 

Goodluck to everyone and hope  those of you who are still waiting get a response soon!

Same here. And I read that if your case is not transferred to your local office down the line, and is processed by NBC all the way through, it means that your interview is waived. Too early for us to know I believe.

I love the apps! I would like to note though that the app mentioned above did not work properly for iPhone users when I was trying to track my case for K-1. There is another one, called Case Tracker with a bald eagle that works better for the iPhone.

And if you click on Search, and then enter your case number (or a smaller random number), pick a number up to 500 and click Count, it gives you the status of all the cases after that case number. So you can see how the other cases are doing. Sure it is too early for anything right now, but it helps to kill the time and awesome to fiddle with when the anxiety hits.
