When he called the first time they said that she wasn't listed in the petition which was far from the truth, but they reviewed it and they told him she doesn't have to be listed on the NOA1 since she was traveling with me. I guess they only list the beneficiary

No kids myself, but I've seen other people talking about how the kids weren't listed on the NOA's, but then they show up when checking at the ceac website with the NVC case number.

Since the child can join or accompany the beneficiary parent, they aren't listed on the NOA1 or NOA2. When you go to file for the K1 visa on the CEAC it will ask you if you have any children accompanying to the U.S. That's when you answer yes and list the name(s) and information. 

 

If you select no, then you have 1 year from the K1 issued date to apply for the K2 for the child without having to pay a fee. After the year and you don't file, you have to file the I-130 which requires the fee and goes through the full process.

Ouch. Sucks if you have to bring your kid after a year. After this I want to wait for nothing without my fiance lol

I had assumed that because a separate application and fee wasn't necessary for the K2 applicant on the i-129F form and it would be handled when it went to the embassy since that's where you pay separate fees for each beneficiary with the DS-160 form. You gave me a start when you mentioned you had to get it sorted out with USCIS. It bothers me that the USCIS couldn't give you the correct answer from the start. There is enough emotions involved in this process without incorporating unnecessary panic.

USCIS customer service reps nowadays don't give out "correct answers" or "answers" period. They follow the script to the "T". If you ask them how's the weather over there, they will probably give you the same scripted answer as they read it from the paper.

 

But nothing to worry about. The petition of fiancé is about the fiancé and the USC. Because it's optional to bring the child over, and USCIS doesn't handle the visa issuing part of the process (such as the payment and application); the child won't be a part of the process until it's time for the beneficiary to file the DS-160 (visa application). Because you have to get the non-custodial or other parent to agree to let the child come over to the US with the beneficiary, the additional cost of paying for a visa fee per foreigner beneficiary, getting adjusted to a new country, etc., is probably why they give the beneficiary a year to apply for the K2 without having to pay fee.

Good Morning to All April filers and to those that are lurking here as well.  I hope that everyone had an enjoyable Independence Day.  We are getting into the meat of it now with July starting.  I am hoping that we all will start seeing some April approvals very soon.  Selfishly :jest:, I want ours to be one of the first, but having a 4/3 date helps with that.  Hopefully the wait is about over for this part and we can get things moving very quickly now.  As someone said earlier,  hoping that the CSC personnel come back from the day off ready to plow through those applications and get ours(April Filers) going.
