Still waiting for my NOA2 :( My fiance asked me last night how long until he would be able to work in the US legally. Does anyone know? I really don't want him to grow restless and resent America.....!!!

It takes up to 3 months to get your Employment Authorization Document (EAD) when you file it with your AoS. AoS and the issuance of the permanent green card takes a year or more but the EAD allows you to work in the interim.

We have the same timeline! I hope we get some good news soon! One of these days I hope. Keep the faith! I am longing for my fiancé a lot. I miss him! Can't focus at work. :(

Do you know if you can file the EAD by itself on the day you get married? 

I think we may be too busy spending quality time together to really have the packet ready for AOS on the day we marry. But I really want to be able to work asap.

I'm not as concerned about the EAD as I probably won't work for a couple of years once I move but the AP worries me! 

 

I have to be able to fly back with my son in June/July for him to spend the summer here in England which was part of the custody agreement we made with his Dad. Fingers crossed!

Yes, it is possible to work, BUT only not on the very visa as such. The K-1 visa does not give you an automatic right to work, but gives you the legal right to obtain a work permit, if you need one.

I know that a lot of people are confused about this whole system. Now I will try to explain it in great detail.

Not many people know, but you can get a work permit on the basis of a bride's visa even before the wedding. I hope no need will make you do it, but such an option is possible. You can apply for this permission right after you arrive in the US, just fill out the I-765 Application For Emblemment Authorization form, pay $ 380 + along with this petition, attach all that is required (passport photo, etc. see the instructions to the form) , And wait for you when this permission will be sent. But there is a small BUT, this permission is valid for 90 days, i.e. Just as much as you are given to get married or leave the country. Such permission is rarely asked, especially no fools to pay 380 dollars for the right to work 90 days of which you have half will go for adaptation after the flight and the search for the work itself.
If you do not need to immediately run to work on arrival, then for you there is a second option, which is more common - to apply for permission after the wedding, along with documents on the green card, this option is well-known, besides it's free, it means For a work permit you do not have to pay if you file this form along with documents on a green card, naturally you have to pay for a green card.

Adjustment of Status. They want more money from you to the tune of about $1250 including the biometrics fee to file for permanent status.

Your EAD cannot be filed until you file your I-485 AoS form.

You can but if you don't do it at the same time than AOS, then you have to pay a fee, while you don't have to pay the fees for AP and EAD if you fill both at the same time than AOS. EAD only is $410. AP only is $575 :o

 

Also lately it's taking more in the range of 4-5 months... it seems it happened to EAD+AP same than is happening with K1's and they are a bit backlogged.

Wow ok, thanks for that info. I think we'll have to do a bit more prep to have it all ready to send off together then. 

Its such a long time to not be able to work. I think I'm going to go insane.
