It's not a requirement that a co-sponsor be on both applications if that's what you are asking. Whether you choose to is really what you feel comfortable with. As long as you're over the poverty guideline for you and your beneficiary(s) you've satisfied the requirements of the K1 visa

Yes, you definitely can have a cosponsor for the i134 if you want to assure you have enough income.

I think where my confusion lies is on what basis do they judge that you meet the required income level? As I posted earlier, I have a job, and I am well above the 125% threshold for a two person household. I can prove this using direct deposits to my bank account, pay stubs, employer verification, and other financial records. However, I cannot prove this using my previous year's tax return, as my fiancee and I graduated from college in May 2016. I had a 6 month internship before truly starting my career in February 2017, so my 2016 taxable earnings are below the poverty line. So, if I can prove that I currently make in excess of the 125% threshold even though I can't show that on my 2016 tax information, do I even need a cosponsor? Or is it absolutely required that your previous year's tax information also show that you are in excess of the threshold? My interpretation was that you must be in excess of the threshold both on your previous year's tax information and your current financial information. If that is true, then I will need a cosponsor. Does that make sense?

Your tax records aren't used to verify your income level. That's why you have employer and salary statements. The tax records do lend credence to your ability to sustain your income level but in no way should prevent you from qualifying.

 

Edit: In addition, NOT having filed taxes when you had income you should have paid taxes on could disqualify you from eligibility. They are definitely interested in that aspect.

Well, that's not the general norm, I don't think so. They care about the current situation, but I guess it might vary depending on the country, as some of them ask for only one year taxes, while others ask for three and maybe some don't even specifically ask for any, but just whatever documents show your capacity to accomplish the minimum required.

Maybe try to ask someone that has already gone through your Embassy to see if they know better what they ask for, along with checking the website.

Hi - thanks for that clarification. For anyone else in a similar situation, I went back and re-read the instructions form again and found the following (link - https://www.uscis.gov/i-864):

 

"This affidavit is a contract between a sponsor and the U.S. Government. Completing and signing Form I-864 makes you the sponsor. You must show on this affidavit that you have enough income and/or assets to maintain the intending immigrant(s) and the rest of your household at 125 percent of the Federal Poverty Guidelines. By signing Form I-864, you are agreeing to use your resources to support the intending immigrant(s) named in this affidavit, if it becomes necessary"

 

No where in there does it mention that meeting 125% of the threshold must also be reflected on your previous year's tax return; it only mentions that you must meet it. On the checklist on the last page, it indicates that your previous year's tax returns (and up to 3 years previous, if you so choose) are required to be submitted with the form.

I've been a lurker until I saw the earlier post abut cosponsors. So here is some timeline info. My received date is April 10 and NOA1 date is April 13. I'm still waiting for my NOA2, but it should be here any day now. It might already be in the mail!

I did start a thread looking for info on the Packet 3 for Indonesia and the Jakarta embassy. They do require tax forms, so I will send them in. Here is the link for any other Indonesians/Petitioners with Indonesian fiance(e)s.

I am using an employee letter bc I started my job in march. A bank statement- bc it will show how mch have deposited this year have which is above poverty. And Pay stubs for this year. I finished grad school last year in June so my last year tax info will not reflect well. But I will also bring past 3 years Bank statements. I'm not getting a cosponsor because my family is in a transition this year. Does this sound okay?

Is your annual income in your current job enough to meet the requirements? Then you wouldn't need to use savings, though you can if you want to.

 

If you need to use savings because the annual salary is not enough, then keep in mind you need three times the savings and/or assets to complete the desired amount.

For example, if you need to meet the guidelines requirement for 2 people, that it's around $20300, and your income was $15300, then you would need $15000 in savings (5000*3).

What are the numbers? I don't have any fancy apps to track approvals. I have snail mail and that's it and nothing came in the mail today
