I hope not because that will be unfortunate. Come to think of it maybe since they maybe have not received your withdrawal that's y they have issued the approval you can maybe call uscis and request for cancellation of your withdrawal. I suggest you call them first thing Monday morning and as they said here before 11am US time so you can get thru. Good luck I hope you will have a favorable outcome.

If you want to call have him give you the number or go to USCIS website and get the number.

i ask him to call again. coz badly USCIs only entertain petitioners.. thats what the Csr said when i called 😣

I'm not so sure your lawyer is well informed.  Did you post about this in the main forum yet?  There are people with years of immigration experience and law experience on VJ.  I would exhaust all options before planning ahead with a spousal visa.  Because that is going to be another year.

yeah. and as stated because the was approve before the letter arrive and the CSR said , no bigdeal. but im contented with her answer though..

more than likely the agent noted your file because she recommended continuing the process. I would be prepared to overwhelm them with proof of relationship at embassy stage if it makes it that far.

According too USCIS website

 

Sec 20.4 Withdrawal of Petition 

 

Petitioner may voluntarily withdraw petition PRIOR to adjudication....

 

After approval: A petition can be withdrawn by submitting a notarized letter of withdrawal with names, birthdays, NVC case number etc to NVC and the Embassy/Consulate of country in question . Letter must also contain reason for withdrawal.

yeah yeah. i know. just kidding aside.. 

 

ok. so for the broad explanation. my F sent the withdrawal letter before the Noa2. thats 7/25.. the approval date is 7/28.. and also he only had it handwritten.. and without reason and also without notarized.. because when he ask the lawyer they said, again no need to notarize it. 😖

Ok...If petition was approved or started adjudicating your case before they received the withdraw letter, then it is ignored by USCIS. null and void.

Once it has been approved, it is now jurisdiction of NVC; therefore a notorized withdraw letter with reason for withdraw, must be mailed to NVC and Embassy. So the CSR telling your F no big deal just continue the process is accurate. USCIS has to receive a letter of withdraw from NVC to act on it because your petition was already approved.

So nvC will not received our letter then? what if the UsCis Received the letter update it in their system and nvc will see it Late? and i remember lawyer said, what if they will see it late and im already in the i terview for aure they will deny my visa coz theyll see that it has been withdrawn. 😣

That's why I mentioned over-whelming them with proof of relationship, plus if your F will not be present at interview, then He should prepare a statement as to reason for withdraw and you should have that with you at interview in case it comes up. also since you mentioned he has vacation coming up in October (or he did ) it might be wise to time that around your interview due to the extenuating circumstances involved here.

 

Just remember: Philippines is averaging 10 days from interview until visa in hand.

oh thankyou so much.. i really hope they wont acknowledge the letter aince its not notarized.. and i think he wont make it by the time of interview, coz im still in Saudi arabia.. will pay the Visa if ever On October. ThankYou so much

Don't forget OFW's must get police clearances from every country you have lived in for 6 months or more. some take way too long so don't delay;)  God Bless you both and good luck
