Need some help as I am a bit confused. Reason I am asking is that my wife will be traveling back home to visit her country and I just want to be sure we have all her documents in correct 'working' order before she leaves. My question actually originated as my wife just got a job and on the Wisconsin W2 (tax) form that we have to fill out there is a box that asks if the name on the W2 is the same as social security card (in this case it is not, since we have been using my last name for both of us) - if the name is the not the same, it lists a number to call and states that we must get her a new social security card....

Here is the situation - we were married on Sept 9 of 2006 and the following is what our documents say:

Social Security card - has her maiden last name

Permanent Resident card - has her maiden last name

native country passport - has her maiden last name

her new US person documents like driver's license, checks, credit card, car title, etc. are all in her 'married' (my) name.

We had wanted to have her take my last name upon marriage - I looked at our marriage license and am unsure if this officially changes her last name or not - conflicting info on the web - is a marriage license sufficient court documentation to change a name? If so, do we need to change her green card? Will she have problems coming back home after her trip? If we should change her green card - how do we do this?

Also, when she travels - she will have her permanent resident card with her of course, and also her native country passport but not a us passport - will this be a problem? how long does she have to wait before she can be issued a us passport - she has 2 year conditions on her permanent resident card...

really appreciate the help - this site has been invaluable to us so far in our process as we have done this all without a lawyer - thanks thanks thanks!!!!

You can update her SS card to married name, her SS# number will remain the same. About getting a US passport, she can't have it at the moment, she still need to apply a 10 yrs GC and within 3 years as a LPR ( condition and unconditional) before she can apply for US citizenship to get a US passport. In changing her maiden name to her married name she can go to the nearest Embassy of her country to amend her passport. She can change her name in her GC if she in filing the I-751 (removing the conditions of residence) next time. But I don't see any problem if she want to have a vacation right now, she got her GC! She had also your marriage certificate, and other married name identification.

Better advice from anybody?

Nov. 18, 2009.....Oath Ceremony...yahooooooooo!!!!!!!!!
