If you take all of your other documents showing that you guys are actually together because you love each other, the kids would just be a bonus.... think of it that way.  Good Luck

that is irrelevant. there is no way to prove a person did not. it can only be proven that it did happen. I don't mean to offend I am just pointing out that the evidence you are trying to use can easily be recreated without the close emotional bond that is marriage there för it can not be used to prove marriage.

 Life insurance beneficiaries.

Add each other to bank accounts, credit card accounts - I was listed as a family member on my husband's bank before I was an account holder (not going to assume all banks have this feature though) and we submitted the account info page showing as such.

Pictures of your wedding, with your children, with each other's family members.

Mail for you both to the same address.

Just about anything that shows, despite the distance, your lives are very much entwined.

Most of all, don't worry. You have what evidence you have, until your husband has a SSN and actually lives with you then you won't be expected to have the Earth of evidence.

Thank you so much! We don't have any joint accounts or any kind of joint Financial things :( all I can get are affidavits of people that know us that we have a real relationship. I am kinda of worried now.

is your husband in the US? (I'm assuming not since you're just filing I-130 and not i-485)

If so, is there a way you can get him on your bank accounts etc? (and also: I'd file i-485 concurrently)

If not, official documentation of your travels together /him coming to you (passport stamps, tickets, hotel bills)+photos putting you at the same place, wedding pictures if you have any, pictures of you both with the babies (congrats btw!), call/message logs/screen shots of you Skyping with the babies...

As personal experience and for what I've read it's just not about having kids but showing that you are both active parents in the kids lives and by this I don't mind just pictures but oficial documentation like doctors records etc plus more evidence of a real marriage ...when I did my AOS interview she asked me for birth certificate of my kids and then gave me back the one from my older kid because she is not my husband's biological kid and jus kept the one from the kid born in the marriage but then she still asked for the rest of the proof so in my opinion yes it "helps" but you can't rely completely on just having kids

Hey all this may seem like a silly question but here it goes: I am filing a I130 for my husband. We know each other since 2013 and got married July 2016 and in April 2016 I have birth to our twins. So the question is does having children with someone rule out all doubt for the person who will be interviewing us? Will they see oh they have kids so of course it's a bona-fide marriage and no further questions asked? Does anyone have experience with this? Thank you all

I don't know if things have changed since I filed for my husband (2013), but at the time, while USCIS asked for bona fide evidence there seemed to be an understanding that married couples living apart due to immigration probably wouldn't have as much evidence.  All I included was evidence of my pregnancy (plus passport stamps showing I was with my husband at the time of conception), an affidavit and some facebook screenshots that showed his family commenting on our relationship.  At the time that was enough.  We didn't have any financial co-mingling, as we were not residents of the same country.  I don't know if it might be different if you are dealing with a high-fraud country, however.

Good luck and congrats on your children and marriage.

Twins, how lovely!  But you will have to submit other ways to prove your relationship. Can't you open up a joint savings account or checking account together? Also you can make living wills, have them notarized. You can put him as the beneficiary of your insurance at work, if you have it. Good luck!

The biggest factor to start with is what country is your spouse from????? you cant compare apples to oranges in immigration.. i wouldnt compare a NZ citizen to someone from morocco and the USCIS reps know what to look for and how to treat certain embassies.  if you are from a low fraud country the interview is a breeze, and if not its more difficult.

Yes, I think that is more than enough.. My husband and I were married for less than a year and then we got pregnant. We had our meeting with USCIS when I was like 4 months pregnant, we brought pictures too but she was satisfied with my pregnancy as proof. Along with bank statements of course.

Congratulations on the twins! That's very exciting!

My husband and I didn't have any joint accounts when we applied, so we provided other forms of evidence. There are many different types of evidence you can submit. Here's a couple of ideas:

 - The best form of evidence is proofs of trips to your husband's country and time spent together. This includes boarding passes, visa stamps, hotel receipts, and photos of you together. Pictures should be of you two in different locations from different days and pictures with family members, friends, etc.

 - Evidence from your wedding such as receipts from rings, clothing, food, venue, and of course photos.

 - Proof of conversations including chats, phone call or Skype logs.

 - I was able to add my husband to my health insurance and make him a beneficiary of my life insurance.

 - You can also try to add his name to an apartment lease, utility bill, etc.

Here's a list of what we sent in. Like someone else said though I am from NZ so you can't compare to if you're from a high fraud country.  NZ is not a high fraud country but yet I still provided a lot of evidence just to be safe.  This is my table of contents so its a good breakdown.  I didn't get any RFE's. (further evidence requests)

SECTION 1:  FORMS

·       I-130 petition for alien relative

·       G-325A Biographic Information (petitioner)

·       G-325A Biographic Information (beneficiary)

·       G-1145 e-notification of Application/Petition Acceptance

SECTION 2:  IDENTIFICATION

·       Certified passport copy  (petitioner)

·       Certified passport copy  (beneficiary)

·       Passport size photos

SECTION 3:  PROOF OF MARRIAGE AUTHENTICITY

·       Marriage certificate

·       Wedding photos

·       Baby ultrasound pictures, pregnancy announcement & letter from doctor

SECTION 4:  PROOF OF LIVING TOGETHER & LENGTH OF RELATIONSHIP

·       Copy of lease agreements held together

·       Joint bank account letter from bank (showing when our account was opened)

·       Co-mingling of finances – joint bank account transactions for dinners, outings, etc.

·       Rental receipts – printout of bank statement from joint account

·       Evidence of relationship start date – facebook

·       Evidence of early relationship – visits to each other doing long distance

·       Spouse moves to Australia – flight itinerary

·       Temporary spousal visa for Australia

·       Flight itinerary for first family Christmas

·       Various photos of the two of us over the years as a couple

SECTION 5:  EVIDENCE OF OTHER TRIPS TAKEN TOGETHER

·       (listed trips taken, year and month of trip, and whether it was photos or photos and itinerary for each... then provided a collage of pictures for each trip along with itinerary).  I've removed the details here just for privacy reasons.

I listed 8 different trips we took including me visiting his family, him visiting my family, our honeymoon, anniversary trips, cruise holidays etc.  So it wasn't just one or two things.

PS: as you can see, having a baby together is just a tiny part of our evidence.

Congrats on the twins! What a blessing!

Unfortunately having children together is not evidence of bona-fide  marriage.
When my husband and I applied for my I-130 we had no bank accounts or leases together or anything. I sent hundreds of pictures (of all our visits to each others' cities), screenshots of whatsapp and facebook conversations, copies of passport stamps, marriage certificate, hotel reservations copies with both our names for vacations we took together, simple things I had kept for many years for a scrapbook I never made cause I'm not artistic at all lol.

For my removal of conditions I sent copies of ID's tickets and hotel reservations with both our names, every single bank statement we've received since I moved here, etc.

Send everything you can of the two of you together, anything that shows that you are more than just acquaintances that married each other for a visa...

God luck with everything! :)

Wow! Thank you for your answer. I had no idea I am truly shocked that someone would borrow a child. And part of a deal for a green card even more sad! You made me a little worried. If anything I can provide them with dna evidence that my twins are his kids. Would that help?

STOP BEING PARANOID ...... USCIS is a monster of admin delay no more ..... scams are scams and you have zero issues, there is always 1% who are F****** and they live everywhere .....

Rest easy, USCIS trips your mind ..... we have enough madness in our lives without worrying about the "system"

No there's no need for that. The birth certificates for the twins showing both your names are ample evidence of being parents to children together. Try not to worry so much. All people are saying is that kids together is one piece of evidence, not the whole package.

All the best :-)

PS: Hope the list of what I provided has helped
