Hi everyone,

 

My husband is petitioning (I-130 + I-864) for me to adjust my status from F-1/OPT.

Both of us are self-employed. For the most recent tax year, we both have an annual income below the current requirement, but our combined household income does meet the requirement (although not for the two years before that).

I as the intended immigrant have US-based real estate property under my name.

Would my asset plus our combined household income be sufficient? Would you suggest that we still get a joint sponsor?

 

**I am asking this because we went to a free consultation and were told that my asset (and even income) would not work although the I-864 instruction clearly says so.

I wonder if it is because USCIS tends to reject applications like mine or eventually asks for additional supporting documents after reviewing cases like this.

Well, it may help but did they mean that it is not enough? Remember that assets are handled differently than income. Use this method:

 

  1. Take your current household income and deduct it from the figure outlined in the guidelines (125% HHS-PG for your state). Whatever is left over multiply by 5. this is (a)
  2. Take the value of your real estate, subtract whatever you owe on it to banks, parents etc. This is (b)
  3. If (b) is greater than (a) then you are good to go!

You have to be able to prove the value of the property, though, get it valued by several people and make sure you have the evidence. If you have the option of adding a joint sponsor as well then do it, you cannot have too much money on the I-864.
