There is no need to, ICE is very much capable of doing this themselves. If there is even a question of legal status, that's what it's for.

I think it's downright hilarious watching you try and act like this is somehow burdensome to local authorities. It's not, at all.

I happen to know several law enforcement officers who believe it's a huge burden onto them.  Especially if it comes down to getting a call about a suspect illegal alien and a violent crime.

Because you're opening up a can of worms.  Say his name is Jose Cuervo.  Do you automatically ask for status?  What do you base that on?  Two words: racial profiling.  If his name was Tom Jones one likely wouldn't ask for status.

Well, I'd suggest automatically getting the status on everyone that's arrested, but it would be quite unnecessary. At very least though it would help make sure a lot more illegals would be caught, regardless of what their name is or where they're from. And while Hispanics tend to be the most prevalent they are far from the only type of people who are illegals.

That's why they pick up a phone, call ICE. If their status is actually legal, ICE tells them they are fine and to proceed with whatever their normal SOP is with criminals.

Process over.

The whining about "boo hoo police state" is quite hilarious.

   RINGING PHONE

- Special agent Smith speaking.

- Hello. My name is Joe Doe from Metro police.

- How can I help you?

- I have an illegal.

- Illegal what?

- Illegal person.

- Oh! How do you know this person is illegal.

- She has no papers.

- And what do you expect us to do?

- Deport her.

- To where.

- Hold on.

   (Muffled voices in the background)

- You still there?

- Yes.

- She said she's waiting for her greencard. Something about AOS, AOL, Compuserve.

- Compuserve? How old is she?

- Hold on.

  (Muffled voices in the background).

- She's 29.

- Does she speak English?

- Yes, and quite well.

- Hmmm. Where should we send her.

- Mexico. Isn't there where all the illegals come from?

- Where are you?

- Seattle.

- Ok. Can you drive her to San Diego and meet me at the border?

- What?

- We will send her back to Mexico, if that's what you want.

- No, I don't want that.

- Then what DO you want?

- I don't know. I read on VJ that I should call ICE...

- You did. Now what?

- I dunno. What should I do?

- Officer, you should read the constitution. You have no business meddling in federal affairs.

Your last sentence...Exactly my point!  But whenever you see anything about illegal immigration the first words are usually Mexico, South America, Cuba.

asking everyone status could very quickly become a firestorm

this has nothing to do with something being "burdensome" to local authorities. this isn't about 'burden" or "effort"

Given all the paperwork police deal with on a daily basis, reading statements, and traveling to court memorizing incidents to be challenged by lawyers while testifying, making a phone call or validating immigrant status over a computer isn't burdensome whatsoever -- complying jurisdictions could do it all while on the way to the station, in fact. No pun intended, but that's a cop-out. Clearly this is from people who simply don't want to abide by the law.

My take on this is that it's not the local law enforcements jobs to check immigration status, but if ICE asks them to retain that individual for pickup they should. It suppose to be a partnership between the local and federal enforcement agency. Too often we get extreme views on both sides.

You're right. It's about social justice. Problem is, the law doesn't care about this.
