Dear friends, please i need you all to help me out on what to do. i received a notification for an interview coming up next month on 04/17/2017. And in the notice some requirements are demanded for to proof that our marriage is not a sham. since i haven't received my EAD to proceess my SSN there is no way i can be added on anything on my spouse account. am talking about insurance, utility bills, joint bank account, even the rental agreement cos he has been living in the same apartment for 2years before we got married and the said lease will expire on MAY 2017 so my name was not on the lease and many other things to prove our live is intertwine except for our wedding, courtship and events photo with families and friends. But recently i received a notification on my I-765 that the new card is being produced. Our worries now is will it be possible after we received the EAD and have the SSN, can we start to apply for joint bank account and the likes before the interview date. please advise.

SSN should have been acquired before the marriage.

EAD has nothing really to do with you and a SSN.

Also a lot of apartments went a renewal contract to be signed 60 days prior to the expiration of the current lease, so you could renew and add your name onto the new contract....

If you can't manage to get any of the things you listed all you can do is take what you have.

You can't go back in time and apply for a SSN before marriage, so I would say yes, get it once your EAD is in, get added to whatever accounts, insurance, etc, you can, including the lease. Have you filed for the 2016 taxes yet? Jointly filed taxes are also good evidence.

I heard and read many times that some people who came to the US on a K1 visa didn't have a AOS interview because of the K1 visa interview at the foreign spouse's US embassy in their home country.

How do they determine if USCIS sets an interview appointment for you or not? Do they base that on how smooth your K1 visa interview went?

I'm just curious why some people receive an interview letter and some don't.

Just randomly selected, there is no pattern. Also, every field office has to make a certain number or percentage to fulfill their interview number which is required by USCIS. So if there are not many ppl with their field office in let's say Portland, they might end up having to give every single person an interview even if they all came on K1 and didn't have any red flags so they can meet the interview number requirements.

But why do you worry about that so much? In the end it's usually better to get an interview because that means you get your greencard faster. The applications from the ppl who get their interview waived stay at the national benefits center. National benefits center are swamped with applications so it usually ends up taking a looooong time to get your greencard.

There is no way to know/determine whether you will get an interview or not. It appear that those who do get AOS interviews get through the process quicker (assuming no major issue were found during the interview).

My wife had an interview during the AOS stage, but not for the ROC.

If you haven't been married for long they won't expect extensive proof of co-mingling finances.

What I have so far with my husband (apart from joint bank account) are things like he added me to his gym membership and is paying for it, I am on his health insurance, we are one the same phone bill. Those are things that don't require a SSN but are proof that our marriage is legit.

On a side note: Bank of America doesn't require a SSN. You could've always had a joint bank account with them, you can still go and open one now although that might be seen as just being done for the interview now.

I wouldn't worry about it too much. Bring extensive proof of a bonafide relationship and you should be fine! I'd be happy if I would have my greencard so quickly on hand.

Actually my husband and I had to show both our SSN's when we opened a bank account with Bank of America last week.

Might be different at other BoA service centers.

They asked for it but I'm sure it had been fine if you didn't have a SSN. They also asked for a SSN when I was in the US on a B1 visa and when I said that I don't have one and whether that is a problem they said no it's fine they just have to ask for it in case I had one.

Of course it may very from branch to branch but I've given this advice to a lot of VJ members before and they all got a SSN with BOA. I think it's just people assuming that you need one because they say the assistant asked for it but it's fine if you just say no and and prove your legal status to them. BOA is known for giving bank accounts to anyone and credit cards as well. It's not a bank with a reputation to lose because they already hit the bottom. ;)
