We tried that and were denied , you need to get her congressman involved to find the reason of denial and see if he can talk to a sipervisor before the case leaves Ghana its slim chance but worth a try.

Are you saying that the USC has to move to the beneficiary's country for 2 years and wait?

If someone is working, how can he or she just leave and go some place else? Leaving a job for that long is almost like quitting unless a leave of absence is granted.

If someone owns his or her own business, then that's something else if you can leave it running in capable hands.

No. The USC doesn't *have* to do any thing. But, if you want to be together, once in this situation, to have the USC move to be with you is an option. Granted, it is not an option many people can choose. However, you two need to spend as much face-to-face time as you can, if you want to overcome this and have your application accepted - whenever that may be. So, either the USC moves there, or makes as many trips to visit you as possible. 

I hate to have to point this out, but remember - being granted entry to the United States is not a right, it is a privilege. It is going to be incumbent upon you and your spouse to now do whatever it takes to prove beyond a doubt that your relationship is bonafide. 

This is a chance every couple involved in an international relationship/marriage faces - especially coming from the countries the U.S. State Department considers to be "high fraud." Add to that, short courtships, marriages on the first visit, etc...it's quite a burden of proof to overcome, but it can be done.

Exactly what I meant to say, and if your truly in love you will make it work, houses jobs etc are replaceable.

Chances are zero because you have shown immigrant intent and you can't overcome the requirement of strong ties in Ghana

with a wife in the US. Wife has to move to Ghana or make several more visits.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

All you have mentioned is art work and video calls and Facebook. This is Africa and parental acceptance is vital to an approval. Did you submit pictures with your family, parents friends? All 3 visits showing difference venues. Or did you rely just on Facebook post. When they say fake or set up they are speaking to whoever but you are posting and interacting. I have had a few people get that noted in their denial that their Facebook was just created to appease immigration. Facebook you have friends, family to talk debate whatever. Not just I loves you's with just you two.

 

And the Facebook might be a sticking point because you didn't know. Remember you are married they expect you to know such things and not be blindsided at an interview.

 

Ghana is big on visits of long duration. When you have red flags like you do (the age no big deal) but a divorced woman with 3 kids is ages of maturity(well generally speaking) older. It's a big deal. They are approving a visa for you to  immigrate to a whole family not just her.

 

Me and my husband had red flags so I moved to Nigeria stayed from approval at USCIS to Visa in hand 6 months later. We also meet 6 months before we got married first visit. And this after I divorced my previous Nigerian husband 30 days prior to marriage. You have to do what's needed.

 

Unfortunately nothing you can do. You are in for quite a wait. People I am helping now had denials in January and February of 2015 just having interview. Expect now 18 months to even hear from USCIS. Keep the visits going.  And Ghana truly holds on to petitions usually 6 to 8 months before they ever even send them back. Then it will sit until reviewed for Revocation.

 

Wow dwheels76, i'm praying to be an exception to the norm.  Jude was denied June 14, 2016, Uscis received it September 2016, received Noir January 23, they recieved evidence Feb. 27.

The same thing happened to me the first time. What a frustrating thing to have to go through. They will send the case back to the uscis and ask them to revoke the petition. Ur spouse will be mailed out a noir (notice of intent to reboke) It literally took one year for me to receive mine. I then sent a response and my petition was still revoked. I read where some folks were able to overcome the noirs but majority are not. The CO who denied my husbands visa stated a lot of erroneous statements that were flat out lies. I was actually at the interview with him but I wasn't able to talk. Anymuch, ur best bet is to reapply. Good luck.

so have you got your NOIR?

 If you havent then that's  the checks that they supposedly resulting in many waiting over a year for.

This is what I have done so far...Still waiting for response.

I submitted FOIA to USCIS asking for consular notes. I was given a tracking number to check the status of the request.

if I am going to wait, I am going to make them work while I wait.

The FOIA response should be in within 72 days. I sent mine in March..

You can also use your elected officials to keep inquiring.

My plan is to keep someone "touching" my case until they get sick and tired of me.

 

 

That's very possible. Some people get reaffirmed without getting NOIR/NOID. Just keep staying proactive on it.

Ours is back from ghana to Uscis so the ceac still says same expiring visa because is  over a year . I did receive a mail today said they are waiting on the security checks to finish the visa so hope this is good news but they also said they have no idea how long they will have to wait on those😬

Did you reapply ? And what was different the second time and did it go faster?
