I130 for my husband (both of us live outside US)

Hi everyone, 

Just signed up for visajourney and this is my first post. I am an American citizen living in Turkey for the last 5 years. My husband and I got married December 2015. He is a Croation citizen (resident permit for Turkey). We have decided to move to the states. I have all the required documents and I130 and I130A filled out. I would like to know if I have to file affidavit of support at the same time or can I do that after I130 is approved. I will have my aunt be co-sponsor for since I do not have domicile in US. Thank you in advance

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Hi! We are also filing abroad and my husband is Croatian. I just wanted to forewarn you that getting the Croatian police report (for the NVC stage - the next set of paperwork) from abroad will be difficult and that he mght have to come to Croatia to get it. It is 2 pages - one from the court is Zagreb (someone else can get that if they have power of attorney, or it can be requested by mail but not sure if they'll send it abroad) and the other is from his local court (not sure if that can be taken by someone other than him). I have the Croatian names for the papers/courts if you need them. Just wanted to give you a heads up as we were delayed waiting for those papers :)

 

You won't need the police certificates or anything else until the next stage, 4 to 6 months from now. But it is good to be proactive and have your paperwork ready so that the process goes faster.

 

Oh, if your husband was born in Croatia, for the birth certificate he needs "izvadak iz matice rodenih" not "rodni list" (also for the next stage of paperwork). :)

It is not an issue, but it does mean that we are required to do MORE paperwork. The US citizen has to provide evidence for "intent to re-establish domicile". Basically they want assurance that the US citizen will move to America with/before the immigrant and not remain abroad.

I'm in the same situation and we are filing directly with the embassy in our resident country. If turkey has that option I would highly recommend you go through them. The process is much faster. Laulholley is correct in that getting police reports will take time. Also immunization records, birth certificate..etc will take some time so I would recommend getting that process started asap. You will also need everything translated Zzzz...it's a bit mess of paperwork but definitely worth it in the end. Good luck!
