Dear VJ Users,

 

My fiancé and I are both leaving home and fly into the U.S. to begin our next journey. In the midst of scanning the best, the least inexpensive / least time traveling, we stumbled on few options. Here's our situation:

- We're same sex couple

- Flying from Indonesia / Singapore

- Our POE is mostly be Los Angeles - LAX

 

Situation One: "We found a flight with Saudi Arabian Airlines that will transit in Jedah, Saudi Arabia for 5 hours. This was a one-way ticket from Singapore."

QUESTION:

  1. The price for this flight was the least expensive out of all airlines. Our concern is that will we be hassled in Jedah -- for being 2 male flying together and I have a K-1 visa with my fiancé name written on my visa?? We'd really hate for this to happen but then again we'd be in transit Saudi Arabia and it's 'their-land-their-law' situation. What are your thoughts on this??
  2. Should we took the Saudi Arabia flight with the transit in Jedah -- and assuming that we do NOT have any problem during our transit -- would we be hassled when arriving in LAX?? With the current situation on travel ban, and the muslim ban situation, this is another concern of ours. What are your thoughts on this? 

 

 

Situation Two: "We decided to purchase a oneway ticket from Indonesia to the U.S. with LAX as our PoE"

QUESTION:

  1. Will I (the K-1 Visa holder) be hassled for not having a return ticket to my home country? How do I avoid this from happening? Should I request a statement from the U.S. Embassy stating that I am not required to have a return ticket to my home country?

 

 

 

Situation Three: "Apparently purchasing a return ticket leaving the U.S. to my home country (i.e. LAX-DPS return in our case) is so much cheaper than the opposite (i.e. DPS-LAX return). Should we proceed with this option we will not use the LAX-DPS but will use the DPS-LAX to come to the US."

 

QUESTION:

  1. Will this be an issue?? Has anyone tried this method of traveling?

  1. Transit in Jeddah: Unless you need to go through additional passport control, I doubt you'd get into trouble for holding a K-1 with your same sex partner's name on it. 
  2. One-way ticket: It is not an issue for a K-1 holder to have a one-way ticket. The CBP officer at all POEs should know better because you enter the US to marry your fiance within 90 days. Period.
  3. Throwaway ticket: Abandoning your return leg of the tickets are done by people but if you've got refundable tickets, just don't forget to cancel it after you have arrived in the US. However, please note that airlines are cracking down on throwaway tickets.

Question 1: I'll keep that in mind, however we are still somewhat conflicted about this Saudi Arabia Airline option. THANK YOU. 

Question 2: My concern is not with the CBP at the POE in the US but with the Airline Agent / Immigration official at the port of my departure be it in Indonesia / Singapore. 

Question 3: In our case we will be throwing away the ticket leaving the US to Indonesia -- because we're both in Indonesia at the moment and will only use the second aprt of our tickets to "return" to the US. Being that we NEVER really leave the US on the date printed on our ticket / itinerary, I am now worried that we will have an issue when flying to the US with the "return" section of our reservation / tickets. Am I making myself clear here? TLDR; Throwaway the LAX-DPS and only use the DPS-LAX. Will we have a problem with this?

2. It's really none of their business to worry or even hassle you about the one-way ticket :D Don't worry about this. 

3. Ahhh OK. Thanks for clarifying. You'll probably have issues trying to board the return leg because airlines usually have the clause saying that the return leg can only be used upon completion of the first leg. Hope I'm making sense.

Thanks a lot :D Our estimated adjudication date is some time in June 2017. Hopefully we'll be able to breeze through till K-1 and that I'll be in GA by end of the year if not earlier.
