AOS REJECTED BECAUSE WRONG FEES HELP!!!!!!!

Hello dear friends,

 

My worse nightmare came true, they returned my AOS , this is what we sent:

 

all the supporting information and 2 different checks for 

Petition for Alien Relative

         Check for the quantity of $705 ($535+$85+85) $535 fir the form I-130, 85$ for each ( the petitioner and the beneficiary biometric fee) made payable to Department of Homeland Security.

I-485, Adjustment of Status:

         Check the quantity of $1310 ($ 1140+ 85+85) made payable to Department of Homeland for Security, $1140 for the AOS fee, 85$ for each ( the petitioner and the beneficiary biometric fee)

 

also we filled the form for the EAD, my question is did we send more money that we suppose to? do we have to redo our forms ? ( because all our evidence and forms have some type of seal in each page) also how do we should sent the checks? i really need help this is so frustraiting!! thanks so much!!

Sounds like they simply want the correct amounts sent in with all paperwork again.

 

AOS, for one person with I-485 is $1225 for anyone 14-79 years old.  Listed under special instructions specifically : https://www.uscis.gov/i-485

And again for the I-130, same listed specifically at $535 : https://www.uscis.gov/i-130

 

The petitioner does not do a biometrics.

Forms I-765 and I-131 fee's are waived when filed together with adjustment of status so to answer your last question first; no, you do not need to pay for it. Secondly, US citizen petitioners do not need biometrics. This is just for the immigrant, it'll be printed on the employment card and green card and it'll be put in a database. The total amount of the AOS is $1225 (incl biometrics fee for the immigrant) and I-130 is $535, no biometrics fee needs to be included.

Suss&Cam the first thing you said is: don't mean to be rude but you are, if you are gonna help why you have to answer in this way? And nobody born knowing everything, Also I read something in the USCIS page that if you send more money that suppose to you can get the money back which they never did, and I got the Biometrics for my Husband bc they say any person from 14-79 years old, they don't SAY JUST THE BENEFICIARY, and the I-864 is good trust me! My husband did a great job on that, just a fee mistake which they would clarify better in my opinion

The instructions say "the applicant". If you don't understand what that means, you might have trouble with other areas of the immigration forms, which is what @Suss&Camm was helpfully pointing out.

Also, there's no biometric fee for an I-130. You need to closely re-read and make sure you understand all the instructions before trying to file again.

Nowhere do they say that. They say you must submit exact, correct amounts or your petition will be returned.

I don't understand why you would take it that way when I specifically say that is not what is intended. I have seen so many ppl get rfe's for really easily made mistakes on the i-864 that I have helped them correct. I just really think that you should look it over. If you don't want to take the advice (sometimes good advice is not the one we want to hear), then that is up to you. You already have this delay and I was honestly just trying to prevent you from having more such delays down the line. I have better things to do than just try to write things to be rude. The time I spend on here I actually spend trying to help ppl to the best of my ability cause I have just been through this whole process myself!

I didn't read it as rude but more as direct/blunt. There was no attack or snide remark...just saying that you've already made a couple different mistakes on part 1 of the process. Slowing down to properly look over what is needed, ask questions, etc. will save you a lot of time, stress, and frustration later.

 

USCIS requires exact payment. Otherwise they will reject the petition and return it for you to fix it.

"You" means the applicant. While your husband is the sponsor for the I-485, it's your application to adjust status. You don't need to be an immigration lawyer...(almost) none of us are. Just read the guides and ask questions if you aren't sure.

@Jerymar This is a stressful situation ( I mean the whole green card thing) but there's no need to be so upset. Nobody was trying to be rude to you.

I second what @Suss&Camm said. Take the opportunity to double check your package. Trust me, "she" is one of the most helpful people on here.I made a silly mistake that cost me a Request for Evidence and is now delaying my whole case.Take it as a blessing to truly understand what is needed from you by Uscis.

As said previously " good luck"?.I would also recommend checking out immigration counsel places , you can find them online via Uscis  , they can help you fill out your papers for free.( wish I had known about them earlier).

If I can add my two cents here: I think that rudeness might also be a cultural thing, some people are not used to be addressed in such a direct way by a stranger and indeed they might take an answer like that as rude. I totally understand Jerymar's reactions as I also know that probably the answers were not meant to insult in any way.

I think that we should all keep this in mind when talking to each other, and try to find a common, kinder ground to speak.
