Hello all,

My wife and I got married early last year and after the long painful wait she finally joined me late last year on a K3 visa. I wanted to file my taxes for 2006 jointly with her but she does not have a SSN yet. Has anyone been in this situation before at all?

We filed for her EAD about a month ago and I believe once that's approved only then can we get a SS # for her.

Any advise would be helpful. I could use some extra refund for a reception here.

While waiting for the social security number, you can apply for a ITIN when you file your taxes. This will be done on a W-7 form.

Thanks for the reply but I looked at the W-7 form and that clearly states: "If you have, or are eligible for, a social security number. Do not file this form" That's what made me nervous whether I should file that or not. Have you heard of anyone who did this before?

Go ahead and file for the ITIN (we did this last year). If she is not yet eligible for a SSN, then there is no problem.

Your Employment Authorization can be used without a SSN. My husband and I just filed our taxes and we had to go the W7 route as I have not yet received my permanent resident status.
Just to clarify, you do not need permanent resident status to get an SSN. My wife arrived on a K-1 visa, applied for her SSN the next day, and her SSN card in her hands within about two and a half weeks of her arrival - well before we were married and she applied for AOS and EAD.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

Let me clear the air here.....There is a difference

K-1 : ARE Eligible for a SSN#

K-3: NOT eligible for a SSN# until receiving either EAD or Green card.

When filing taxes with a K-3, if the individ. is not eligible to receive a SSN# yet (prior to receiveing EAD or green card) then they can apply for an ITIN for the purpose of filing.

Okay, I have a question. The W7 along with the 1040 takes care of the Federal, but how do you deal with the state (Massachusetts) taxes without a SSN? Some one please help. Only few more days to go before the deadline. I can't seem to find any answers anywhere online.
