Hi! My husband and I got married in Kampala, Uganda last month. He is still there, I'm in the US. We keep hearing conflicting info and opinions...we have started filling out the paperwork for the I-30 but is this the only/quickest way to get him here?  Can he visit here, or I go there, while we are waiting for approval? Also, I have seen varying info about how long it takes, is there any way for sure to find this out? It all seems so confusing to me right now to be honest! Thanks in advance for any help!

The whole process seems to take approx 12 months right now but sometimes less. And yes, that is the quickest way. You can file K-3 but they aren't usually approved before the CR-1 petition is, so they are obsolete, but if you have got the money then you could give it a shot.

 

And yes, he can come visit you and vice versa. It might help your case tremendously at the embassy stage. 

 

And no, there's no way to truly know for sure how long it'll take, all you can do is make sure to do everything as fast as possible. Do your medical as soon as you have the NOA2, make sure he has all the vaccinations required and if not, do those already now so he doesn't later. Gather evidence already now for NVC/embassy stage. Good luck!

Are you the USC? If yes, you are free to travel for sure. As for your alien husband/beneficiary, it has been said that a person with pending petition can travel but he is more likely to get denied at POE as he has 100% intention to immigrate.

he could apply and get it, but nothing is granted, he must give enough evidence that shows ties to he's country and that he has intentions to not stay in the US with you.

However, even if he gets a visitor's visa, that doesn't mean is sure they will let him in in the US.

Some incorrect advice here, although well-intentioned. 

 

There is no additional fee to file an I-129F for a K-3. All it costs is paper, ink and postage. Even though it costs nothing, as has already been correctly stated, the chances of being granted one are almost zero. Most people don't bother with it even though it costs nothing. 

 

Having the medical imnediately after receiving NOA2 is not wise. The medical must be no more than 6 months old on the date you arrive in the USA (hence the visa expiration date is exactly 6 months after the date of the medical) and with the NVC taking at least 11 weeks for document review and the wait for visa interviews in some embassies there is every chance the medical will have expired before the interview. Many countries (including the U.K., for example) will not even allow you to make a medical appointment without an interview date set.

Regarding visiting ... you visiting him in his country will help your case enormously as you can collect itinerary, photos etc from the trips.  Him visiting you on a visitors visa will be more likely to work out earlier in the process than later.  Bear in mine even if he has a visitor visa they can still deny him when he lands in the USA.  He should be 100% honest if they ask his reason for visiting, that he's here to visit his wife for however many days or weeks, and he should have a return ticket, evidene of an existing rental agreement and bank account back home in case they ask for proof that he's returning and has a reason to do so.  
If they ask whether he intends in immigrate he should be honest and say that you have just started the process to do so and plan to immigrate once that process is complete, not before, and hence the reason for the short visit now as he misses his wife.

 

As you near the end of the process they are more likely to deny him. For example my case is at NVC now and I have a friends wedding in the USA in may. I'm not even going to attempt to go because they will most certainly deny me, even though I actually have a B2 visa that lets me go there up to 6 months.  The embassy has already warned me not to go so I'm heeding their warning.  I will wait for my visa and just move then rather than visiting with my husband when he moves back there later this month.

Oh and regarding medicals.  My embassy advised do not do the medical until my case is complete at NVC, as they need to ensure I'm issued with correct paperwork, and that the medical does not lapse.
